Let’s Talk

When I say ‘let’s talk’ does this scare you? For some it should, you know when a woman says, ‘We need to talk,’ it can cause some men to pull up short, shiver in their boots in the sun’s heat, or run and hide. But truthfully, I think it is time for us to have a serious conversation about our shared world.

Now, most of us know we are not the same. Men and women, that is, we are not the same. We were never intended to be the same; we are different for a reason. We complement each other; we balance each other. Men and women are the yin and yang of the world, we are inseparable yet contradictory opposites.

What does this mean in today’s world of division, opposition, and power struggles.

First, it means we don’t understand our real place in the world, so we are constantly clinging to old ways. What is fascinating is watching not just those who have something to gain if they win, but those who have everything to lose and yet still follow the path of either least resistance or worse belief the old ways are best.

Every time I see a woman who supports ‘traditional’ roles without considering outcomes, I want to gnash my teeth, or shake her. Now, do not mistake me, there is nothing wrong with making a personal choice to become a ‘stay-at-home’ wife and mother, if this is truly a personal choice. There is nothing wrong with celebrating the opportunity to raise your children and care for your home, not one single thing. However, what are you doing to ensure your future? Do you have a fallback position? Is your future secure? Can you financially care for yourself if something were to happen to your husband, or should your husband decide you are no longer what he wants and he throws you out for a newer model?

Just asking the question that needs to be asked.

Then there are those women with a platform who use their megaphones to deride other women and strip other women of their opportunities and choices. I honestly don’t just want to shake them, I want their mouths to be duct taped and their megaphones to be stripped from them, permanently. These women are dangerous. They are in it for no reason but performance and attention. While they are making more money than their education would command in the private sector, they are intentionally promoting other women’s loss of rights and opportunities. Let’s be clear, these are the women who cheered the Dodd decision, while actively swallowing their birth control pill every morning. THEY ARE NOT PRO LIFE! What they are is Anti Choice for any woman that is not them. What they are is anti opportunity for any woman that is not them, does not look like them, and does not vote like them. What they are is members of a cult that wants to strip men and women of the right to vote unless that vote is cast for them and theirs.

Just pointing out the obvious, at least I hope it is obvious.

Now we come to the present.

Joe Biden made the hard decision to drop out of the Presidential Race. I hate how he was publicly pressured. I hate how he was publicly embarrassed. I think he deserved better. I am proud of our President and the grace he ultimately showed in his withdrawal and his endorsement of Kamala Harris, his own Vice President.

Kamala Harris, Vice President of the United States of America and Presidential Nominee of the Democratic Party. First Bi-Racial Vice President. First Bi-Racial Presidential Nominee of a major party. First Woman Vice President. She has energized the Democratic Party with her campaign. With ninety-three (93) days before the election, she has had to kick-off campaigning, vet potential vice presidential governing mates, and raise money. She has had to reach out to the cohorts that were indifferent to the Biden campaign and try to win them over, and she has had to try to figure out how she is going to Beat Trump.

What do you think so far?

I have heard a great deal of nonsense so far especially about how America is not ready for a Woman President, and White People won’t vote for her. Here is what I think based on what I see.

  • She has outpaced fund raising, by millions. The grassroots think she is worth backing and so do many others.
  • She has the infrastructure in place to knock on doors and talk to people. The volunteers are already out there, it is amazing to see her team at work in just three short weeks. Just to point out the obvious, her team is from all races, all genders.
  • She hit the campaign trail without blinking an eye. She has crisscrossed the country and she is talking policy. Even where her policy might differ from the administration policy she is plain spoken, unafraid, and clear about where she stands.
  • She doesn’t insult or play childish games with her opponent, she simply answers with, “I am ready, Say it to my Face.” I love her for this!

I am fascinated by the fact the Trump team do not know what to do with a Woman at the head of the ticket. I am even more fascinated they don’t know what to do with a bi-racial woman at the head of the ticket. So what do they do? Drag out their old tired attacks from the Obama years and hope they land. All I can say, we are not the same; men and women that is, we are not the same. This applies equally to the nation, we are not the same nation we were eight years ago and I believe many of us don’t want to go back. I strongly believe there are Democrats, Independents, even Republicans who are looking at the very real differences between the old and tired Donald J. Trump and the new and energized Kamala Harris and saying to themselves, “It is time for change, time for positive energy to move us forward.”

For me? I believe in the country and I believe that most of us will not be held back by ignorance when we step into the polls to cast our votes. We are not the same, but sometimes we come together for the right reasons.

I am appalled at the levels of criminality within our highest government and justice system. I am furious at the disarray within the Democratic Party when they should be standing together, holding the line and ensuring there are no cracks to be seen. I am terrified we are losing the fight to retain our Democratic Republic, our potential, and our opportunity to march toward a better nation and a better future.

For over a century, this nation has marched toward a better future. We stumbled, we often failed in our progress, but we moved forward incrementally, dragging those who fought against a better world with us. We had individuals willing to march, sit, and fight for freedoms and rights guaranteed by our Constitution, though in all too many cases never granted. Each right won, and new freedom granted seemed a step toward a more perfect Union that promised a dream of equality for all.

With a profoundly corrupt SCOTUS and unconcerned their corruption is public knowledge; we sit on the precipice of losing everything one hundred and twenty-four years of progress gained us. In fact, we are on the very edge of losing our Democratic Republic with their latest rulings. When we add the swamp of the GOP and their unwavering loyalty to a man who is wholly unfit to be on the grounds of the White House, let alone in the Oval Office as President, the most powerful man of the free world.

If the principle foundation of our justice system is that no person is above the law, then our thoroughly corrupt SCOTUS has broken trust with the nation and cracked the foundation. With every ruling, they have opened the door to further erosion of our systems of justice and democracy. Every erasure of rights and freedoms signals their disdain for our Constitution and our progress toward a more equal nation.

Finally, looking across the aisle at the sniffling, hand-wringing, and disastrous upheaval in the Democratic Party because Joe Biden is OLD and may have slowed down and had a bad day. Well, yes, he did. He had a bad day and, in truth, had a terrible showing at the debate. But instead of all the chicken with your head cut off running about the yard spewing bullshit coming from within, why the hell didn’t you stand behind your President? Why, in all the burning fires, can’t the Democrats act more like the Republicans, just once? Joe Biden can’t win? Well, clearly not if all the Democrats can do is talk about how he can’t beat the 34 times convicted felon, wanna-be Dictator, sexual predator, sociopathic narcissistic, pathological liar. What the hell?

The political rhetoric, the calls to violence, the pure nastiness we all see and hear every single day is beyond politics as usual and has divided us as a people. Calls for Civil War and calls for secession can only lead to one thing, and we see it at Trump Rallies, on bumper stickers, and even the halls of Congress every single day, an escalation of violence. Now, a Presidential candidate has escaped an assassination attempt. Yes, I think this makes it worse; no matter how I view the man himself, I believe violence doesn’t solve any problems and, in fact, only makes him both a martyr and a hero in the eyes of his base. With his ear winged and Secret Service surrounding him, he pumped his fist in victory. Members of the audience who were interviewed said this ensured his victory in November, does it? Nevermind one person lost their life, or others were critically injured, it took a bit to acknowledge them in the race to blame the Democrats and pump up the Orange One as a Hero.

To all of it, I Dissent. Look below at all we have to lose and ask yourself, are you willing to stop trying? Ask yourself, are you willing to give up on progress? Are you so numb to it all that you are willing to sit it out because you don’t like either candidate, really, is that what you are going to do, to yourself, to the future? Our very existence is on the line, so ask yourself what are you going to do?

Challenges and Concerns: Evaluating the Integrity of Systems in the United States

When we think of corruption, what first comes to mind? There are many meanings of the word, if we look the word up in the dictionary, there will be several different definitions:

  1. dishonest or illegal behavior especially by powerful people (such as government officials or police officers):DEPRAVITY

  2. inducement to wrong by improper or unlawful means (such as bribery) the corruption of government officials

  3. a departure from the original or from what is pure or correct the corruption of a text the corruption of computer files

  4. DECAYDECOMPOSITION the corruption of a carcass

  5. archaic: an agency or influence that corrupts

Where would you say the United States of America falls on the meter of Public Corruption today? At one time, we were the beacon of all that was good; our systems and public institutions were seemingly incorruptible. Our efforts to move the nation forward, while slow, were at least moving toward that promise, penned by Thomas Jefferson and Ben Franklin in the Declaration of Independence, that:

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their creator that they are endowed with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.”

Of course, at the time, Jefferson and Franklin did not foresee that statement encompassing a country of such diversity. Indeed, they did not imagine one day, the people they held in human bondage would be free and standing alongside their progeny as equals. Clearly, with the words “all men,” they failed to imagine that one day, women would rise up, independent of their fathers and husbands. Yet here we are, men and women, standing in the town square and speaking out with diverse voices and experiences.

Or are we?

The world is holding its breath, watching our once incorruptible institutions and wondering what is next and what in Hell is wrong with America. Did our systems hold after January 6? Or are we in a tailspin of failure, heading into the autocracy so many on the right seem to embrace with shocking enthusiasm?

Look closely at the systems, local to federal, and even the fourth estate, the Media. What do you think? Are the systems holding or putting us and the world at risk?

I have often said two truths can be equally valid, and this is one of those times. We are faced with a vacuum of misinformation fomenting fury, stirring hate, and closing the hearts and minds of many during their most formative years. We have young people screaming HAMAS slogans without understanding their meaning, thinking they are standing up to tyranny and genocide. Why do they do this? What is the root cause of this fundamental ignorance?

Here is a sad truth about Americans, one-fifth of Americans between 18-29 believe the Holocaust is a myth. WTF you say, right that is what I say, too. The truth is, the genocide of six million Jewish people, the destruction of the European Romany people, the cruel murder of those deemed ‘less’ the crippled, the mentally disabled; all of this isn’t taught in many US public schools today. But there you have it, the failure of the local systems to teach ‘real’ history about genocide, slavery, and land theft; all of it means we have two, maybe three generations of ignorant, myopic, selfish, and ill-prepared human beings entering the world and these are the leaders of the future; God help us.

The failure of our education systems, from kindergarten to public and private universities, is our most egregious failure. This isn’t accidental; it was planned and executed to near perfection. The final nail in the coffin has been banning books throughout our public schools and libraries; the suppression of knowledge and the ability to develop critical thinking skills in our young people leads to what we see today across the country on university campuses.

Courts and justice systems will be the next significant failure. Over the last 30 years, the erosion of the judiciary branch has slowly been overtaken by political appointments at every critical level. The US Court of Appeals and Supreme Court have been overtaken by the political appointments of the extreme right-wing, fueled by the Heritage Foundation, and funded by those at the top with money to burn and a deep fear for anyone who might jeopardize their power.

Many of us remember the Obama years when the Federal bench sat empty of judges because the US Senate, led by Mitch McConnel, refused to do their job. Here is a stark reminder if you have forgotten:

Obama – 179 Nominees, 142 Appointments – 16.5%

Trump – 239 Nominees, 193 Appointments – 22.4%, including three (3) Supreme Court appointments, one that should have been Obama’s.

So, a stockpiled federal court handpicked by the Federalist Society, with lifetime appointments and intent on destroying progress. We have seen how this is working out for the nation:

Roe v. Wade – overturned

Biden v. Nebraska – Student Loan Forgiveness unconstitutional

Students for Fair Admissions v. Harvard & North Carolina University – ruled Affirmative Action in admissions unconstitutional.

Finally, we have to look at the cases that struck the heart of Voting Rights and have slowly but surely diminished all that was won.

Shelby County v. Holder 2013 – struck down preclearance

Abbott v. Perez 2018 – the court ruled state legislatures were entitled to a presumption of good faith in redistricting.

Brnovitch v. DNC 2022 –  in which five so-called guideposts were identified to assess whether election laws were discriminatory under Section 2, devised by Justice Samuel Alito. Voting Rights advocates and election attorneys decried them as too broad and designed to undercut future challenges.

So ask yourself, are our systems holding? The two presumptive nominees for President are running neck and neck right now. One is currently sitting in court every single day as a ‘defendant’ in one of many of his criminal cases. The other is the President of the United States. One wants to be a Dictator. The other wants to be President one more time. Both are in their sunset years. One is a vulgarian, a want-to-be despot, and a traitor to everything this nation says they hold precious. The other, well, he has served this nation his entire adult life; I know that I haven’t always agreed with him, but I also know that he doesn’t want to burn this nation down.

So, where do we go from here? Will our systems hold? Will we kick the minority-majority to the curb come November, show them what we are made of, and begin to truly rebuild this nation? It is up to those who genuinely believe we can be great; no one will if we don’t do it.

So, we now have our two candidates, a repeat of the 2020 Presidential Election, though it is not really.

One has multiple civil cases where he has been found liable (guilty) and a debt of over half a billion dollars. In any sane world, this would make him ineligible for the presidency simply because it would make him a security risk.

That about sums up the difference between 2020 and 2024, though there is certainly more. Let’s dive into what this election season will look like; it will be long and ugly, of this I have no doubt.

I am astounded by the things said about President Joe Biden by the general public; it is as if they live in an alternate reality. This is not to say that I don’t think there are things he could be doing or could have done better. Nevertheless, to suggest that he has diminished our standing as a nation internationally, this is so ignorant on its face it is impossible for me to even understand.

Then we have the issues of the economy; I get it; many are working hard to make ends meet today, and it still feels like we are running on a treadmill. Under Joe Biden and his administration, we avoided a recession, rebuilt real economic growth, added more jobs, and our recovery outpaced every other Western economy globally. On the downside, housing remains high, groceries have not come down, and gas prices remain high despite our reserves and the fact that we are the largest exporter in the world today.

Let’s pick those two things apart for a minute. In recent polls, the unwashed masses thought Citizen Trump would outperform President Biden on Foreign Policy and the Economy. Not to dwell on this too much, but I think Citizen Trump recently invited Putin to do to NATO allies who didn’t pay their bills? That’s right, “to do whatever the hell you want.” Of course, this significantly distorts the NATO alliance as there are no bills to be paid. There is a guideline that 2% of GDP is spent on defense by each Allied Nation. One other salient fact, everything Citizen Trump has ever said about NATO is a lie, and the only time the NATO Treaty Article 5 has ever been acted on was when this nation was attacked on September 11. Every single NATO nation came to our aid.

There is a reason Ukraine is considered the Breadbasket of the world. Before Russia’s invasion, the nation could feed half a billion people with the crops they grew. The land is some of the most fertile on earth, ideally suited for grains, sunflowers, corn, and soybeans. Ukraine fed itself and exported across Europe, Egypt, Africa, Turkey, and China. With Russia’s invasion, not only has farming been stopped in much of the country, exports have obviously been stopped, causing a sharp rise in food prices worldwide and in some cases, food shortages.

Citizen Trump says, let Putin have it. Stop all aid to Ukraine. The House GOP says Okay.

President Biden, says give me an aide package. Support our Ally, as we promised we would. This is not just for Ukraine but for our National Security, and he is right. This is to prevent Putin from moving into a sovereign nation. This is to support an ally. This is to keep our standing in the world. We don’t provide money; we provide them with ordnance already in our stockpile and then make more, providing US jobs. We don’t provide boots on the ground, but if we don’t help Ukraine win this war, we might have to if Putin invades a NATO country.

As for the other, the economy itself? The fact that the people of this nation believe that Citizen Trump and the MAGA GOP would be better than President Joe Biden and his administration speaks volumes. It speaks to the pure simplemindedness of the populace, their willingness to be led by braggarts, their half-truths, and their myopic vision of recent history. Some of these foolish supporters of the MAGA way couldn’t buy toilet paper to wipe their own asses, but they think Citizen Trump has a better understanding of how to handle the national economy.

Let me provide a taste of some of the Poll comments taken recently in support of Citizen Trump:

“As a President, he did many good things for this country. An honest man.”

“He helped the US economy grow.”

“The people of the US were more united under Trump.”

“I think he did a lot for the United States he was good for our country.he is a good man. The country wasn’t in the trouble that it is in now, with gas, food housing, jobs, prices. Look how things are since he Left office.”

“Because he is very humble.”

“He loves America. Always putting America first.”

“He did alot of good for our Country in fighting for Constitutional rights, restoring our own independent energy resources, and getting rid of corruption [deep state], as much as he could.”

Those are just a few of the hundreds, and I can’t take credit for the grammar or spelling, nor did I attempt to clean them up. This, though, is the crazy we are faced with.

When you add the lunacy of a judiciary with jobs for life, many of whom were appointed by Citizen Trump during his time in the Oval Office, and a Supreme Court that appears to be circling the drain of judiciary restraint, what do we have to look forward to in this election cycle? One thing I can guarantee is that it will not be pretty.

Despite the official nominations being months away, we have our candidates, and the campaign season has begun.

Vermin:

a: small common harmful or objectionable animals (such as lice or fleas) that are difficult to control

b: birds and mammals that prey on game

c: animals that at a particular time and place compete (as for food) with humans or domestic animals

This is how Citizen Trump refers to human beings trying to enter this country. He doesn’t differentiate between those entering by legal means from those entering illegally. His only real differentiation is that of those coming across the Southern Border. Now, the interesting thing is four (4) of his five (5) children are the children of immigrant mothers. Citizen Trump himself is the grandson of a draft-dodging, pimp who immigrated from Bavaria (Germany) and set up shop.

So, what is the difference between Citizen Trump and his immigration story? Let me see if I can find it …. pimps, draft dodgers, illegal immigration (Melania)… but, there you go, all of them are, well, what do you know, all of them are Caucasian.

Then you have the oh-so-wholesome and patriotic singing of the National Anthem at his rallies by convicted seditionists and White Supremacists, or as he likes to refer to them .. J6 Hostages. After declaring himself Dictator, He promised his first act will be to pardon all of them.

How do we still view President Joe Biden and Citizen Trump as equal? How are we still comparing them and saying this is a choice between equally bad candidates? What happened to moral character?

There is more, there is so much more, but I think this is enough for today. As I said, it isn’t going to be pretty.

What Fools We Are

I want to consider the United States of America a mostly intelligent nation with mostly kind and compassionate people. I want to, but these days it is difficult. I can’t watch and read the news and say, “Yes, look at all these kind, Christian, and intellectually honest people voicing their political views.”  I am unable to listen to the candidates or public servants from the other side without becoming terrified by their rhetoric and thoughtless diatribes.

In 2015, a man rode down a gold escalator and announced his candidacy for the highest office in the land; we all laughed and thought he was a joke. Donald J. Trump had been a fraud, a thief, a womanizer, an adulterer, and a witless hanger-on in New York high society for decades. He was also a known racist, a known misogynist, and a well-known friend to those with less-than-stellar character for most, if not all, of his adult life. This half-wit based his entire political strategy on two things: racism and his self-proclaimed business savvy, one a proven truth and the other a proven lie. Let’s take a quick look at the foundation of this fraud:

In 1973, the Trump organization was accused by the US Justice Department of racial discrimination, specifically against Black Americans trying to rent properties in their buildings. They settled, and as part of that settlement, they had to agree to change their policies.

In 1989 Trump called for the Death Penalty on the Central Park Five, five teenage Black and Latino youths accused of raping a young woman who were later exonerated. He took out full-page ads and gave interviews during this time.

From 2011 to 2016, Trump pushed the Birther conspiracy about Barack Obama and combined this with the complete fabrication of whether then-President Obama was Christian or not.

In 1990, Fred Trump (his father) bought $3 million in Trump Castle casino chips so Donald could pay interest on his loans. This was later judged to be an illegal loan, and Donald had to pay $65,000 in fines to New Jersey.

1991, Trump Taj Mahal files for bankruptcy relief.

1992, Trump Plaza Hotel files for bankruptcy relief.

Trump forms the Trump Hotel and Casino Resorts as a publicly traded company, retaining 56% of stock. Despite reorganization, the company failed to turn a profit and filed for bankruptcy relief in 2004, 2009, and 2014.

This barely scratches the surface of Trump’s failures and scams.

Trump University. Sued by the State of New York. Settled for $25 million without admitting guilt or malfeasance.

But back to his 2015 announcement, it was full of racist rhetoric, but we should have seen it coming based on his history. We should have also believed him, but we laughed and dismissed him. His announcement was full of braggadocio, and his business acumen and success were a centerpiece. If we hadn’t been so busy laughing at the fool before us, perhaps we wouldn’t be where we are today.

I would like to think America is better than this, but we are proving every day we are not. We have a third-rate backbencher as the Speaker of the House. Our allies are terrified we will leave them at the mercy of Russia and Putin. We have a narcissist, would-be dictator as the third-time GOP presidential candidate who would rather play politics with national security and hopes for an economic crash because it would be good for him. The GOP in Congress has made clear they are nothing more than the support arm of the Trump campaign, installing a MAGA election denier as Chair and the daughter-in-law of twice impeached ex-president as co-chair who together have already said they will funnel funds toward legal fees and ‘poll watchers’ rather than down-ballot candidates.

The halls of Congress echo with songs of praise and hallelujahs for the Orange Jesus that will lead them into the failed nation they claim is already here. The cult of White Grievance, White Nationalism, and White Evangelism is here, and it is led by a man who never once in his life cracked open a Bible, never once met a sin he didn’t want to commit, and never once met a Commandment he didn’t break.

So here we are. We have the two oldest presidential candidates running in the history of this nation. We have voters who wish it were otherwise and are thus unenthusiastic about the Democrat and looking at the Republican as if he might be a viable option. We have an uninformed, under-educated, conspiracy-believing nation full of half-witted bigots who have either forgotten or simply do not care what the first Presidency of Donald J. Trump was and are willing to drink the Kool-Aide of a media bent on destroying this nation as we know it. But let’s take a short trip down memory lane, shall we? This is what happened during the 4 years of the first Trump Administration.

  • Dropped the corporate tax rate from 35% to 21% and created additional tax breaks for the wealthy, more of that trickle-down theory. End result? $7 Trillion was added to the national debt.
  • Multiple trade wars started with China and other nations, resulting in tariffs trickling down to the consumer. Do you wonder why prices are still high? In part, it is because wholesalers and retailers continue to charge the same price despite no longer absorbing the tariffs.
  • The tragedy of the coronavirus was worldwide, but focusing on this nation is important because we had a President who knew how dangerous it was and didn’t just downplay the danger but politicized it.
    • More than 1 million dead Americans
    • More than one-third of small businesses closed during Covid.
    • The average unemployment rate 13%. This is misleading, though it was much higher in some industries, reaching above 20%, and in many cases, these jobs have still not recovered.
    • Schools closed, and children falling behind socially and educationally.
    • In some cities, hospitals and morgues out of capacity.
      • Refrigeration trucks used to store the dead.
      • The sick in hallways being cared for by doctors and nurses, unable to return to their homes for fear they might infect their families.
      • Experts demonized while politicians, including the President, suggested bizarre and dangerous options for cures.
      • The mental health of the entire nation was jeopardized by isolation, joblessness, homelessness, and the loss of loved ones without proper goodbyes.
      • Supply chains were disrupted, creating empty shelves of essentials, and social media showed daily fights in the aisles for toilet paper, diapers, and baby formula.
        • These are just the highlights, and yet, the cult wants to return this nation to this. Somehow, whether the man in the street or the elected official thinks this was the golden age we should be pining for.

I watched the State of the Union President Joe Biden delivered this week and was proud that he was this nation’s President. I was happy to think there was a man in the White House who cared more for this nation than he did for his own enrichment.

Is he old? Is his walk a bit slower? Does he stutter? Yes, to all of that.

Has he and his administration brought us back from the brink of disaster? Yes, to that as well.

When you consider the alternative between the two candidates, remember this; one gives a shit about this country and our standing in the world, about the people of this nation, about the Constitution and what it means, about our Democratic Republic and how we continue to grow great, about the American Dream and how we can all reach it.

The other, well, he sees us as a failed nation ripe for the picking.

Time and Again, What’s in it for us

Now y’all know I love politics. The push and pull of the election season is exciting, most of the time. But this year, damn, it just feels nasty, like someone has taken a bucket of slime and poured it over the entire United States. The stench of ugly is permeating everything and everywhere. It is gangrene on a national level.

Let me say this as nicely as possible before diving into the obvious horror story of the 2024 presidential election year.

I wish Joe Biden would have stuck to his original plan of being a one-term president. This isn’t about his age, though he is indeed old. Let’s all acknowledge he is 81 years old; if he wins in 2024, he will be 82 when he is sworn in and 86 when he finishes his second term. This isn’t ageism talking; this is pure reality; the Presidency is one of the most demanding jobs in the world; it requires mental agility and physical stamina. For his age, Joe is doing well; nevertheless, he is 42 years older than the average American citizen. Yes, I know his experience benefits all of us, which has been proven through this administration. However, with clear sight, his age is a detriment as much as a benefit. He will continue to age, and he will continue to slow down; this is not ageism; it is simply the reality of the human condition, and we need to acknowledge he, and we put this nation at risk by placing him back in office.

The Presidency ages everyone who has ever taken on the job, with one exception, 45; he didn’t age because he didn’t take the job seriously. The Presidency was simply another one of his cons, another way for him to add to his personal coffers both during and after his time in office. He didn’t age because he didn’t do the job the people elected him to do. The one thing we know about 45 is he is aging now; it is serious now, and the piper has come for his payment. His mental acuity is rapidly diminishing. He shows signs of being a person without a firm grasp of reality.

Let’s talk about the GOP, the Grand Old Party, the party of Law and Order, family values, small government, and all that jazz. Let’s talk about these men and women who sit in every seat of power across the land; and stir up controversy, pain, suffering, and dammit sedition. By God, how did we fall so far in such a short time? High School dropouts are walking the halls of Congress and calling themselves leaders. The highest court in the land rife with corruption and laughing as they strip millions of voting rights, body autonomy, and access to education without blinking an eye. The House is full of elected officials with only one agenda; to follow the leadership of a seditious lunatic who has publically stated he wants to see the economy fail and continued border disasters, all to ensure his election success.

We are living the new American Horror Story. A story where women are reduced back to chattel, and worse, all people who are not Heterosexual White Men (HWM) are reduced to “less than.” We are living a nightmare of raging culture wars where Mickey Mouse is an enemy of the people, Taylor Swift is a deep-state plant, and accurate history, along with any book written by or for people not (HWM), are banned from libraries across the nation.

We are living in a nightmare world where the leader of the once Grand Old Party, the party of Eisenhower and Lincoln, is a power-hungry, sexual deviant, with four (4) indictments encompassing ninety-one charges stemming from his criminal acts both while in office and after leaving office, and yet none of this seems to deter his followers one iota. His followers include both the unwashed, unschooled, and ignorant masses but also those who currently hold office in both the Senate and House and who continue to do his bidding. These sycophants who hold high office elected by the people, paid by the people to do the work of the people, and who continue to refuse to do a single thing but trail behind this lunatic would-be dictator, holding his drool cup and beg for the crumbs from his table.

What haven’t they done at the bidding of the outrageous conman who has thus far spent $50,000,000 of campaign funds on his personal legal fees?

  1. They have refused to secure the border between Mexico and the United States. Their most significant complaint is their constant whine, their biggest battle cry. But no, they say we can’t do this today because the Great Orange Jesus says no.
  2. They have refused aid to Ukraine, a nation that has fought hard to retain their own borders their own land, and preserve their democracy from the encroachment of Russia. With less than 5% of our massive defense budget, we can and must save them as we committed. But what does Mike Johnson say to this? NO, he has said with every vote he has cast prior to his elevation to the Speakership, just as the Orange Jesus has told him to do.
  3. They have refused aid to Israel. Now, personally, I am genuinely on the fence with this one; on the one side of that fence is my belief that Israel does not require our financial support, nor does it deserve our support based on their current actions. On the other side of that fence is our national commitment to come to their aid when they are attacked, and there is no mistake; October 7 was an attack by a terrorist organization. On the other hand, Benjamin Netanyahu is a Right Wing nutjob who should not be supported in his stated plan to entirely eliminate the Gaza Strip and West Bank. Frankly, I don’t believe he is any better than 45 and should be treated as a toxic leader along with all of his sycophants. This is not a condemnation of Israel but of him.

What have they done? Nothing that benefits the American People, not one single, solitary thing to now.

Ah, Election Season. We are in for a ride. Are you afraid yet? I sure in the hell am.

Mud, Muck and Fear

Do you wonder sometimes what is wrong with people? Do you listen to what others say and think, “Do you believe what you are saying?”

I do.

There are days when I hear the words that fall from the mouths of strangers and people I thought I knew, and my head tips to the side in astonishment and dismay. Sometimes, I want to scream at them, “What is wrong with you? Are you stupid?”

I realize this isn’t a good response. I know in my heart I shouldn’t do this, and I don’t because it wouldn’t do a bit of good. Besides, they might actually take it as a challenge.

The truth is, though, I think people really are losing their ability to reason. I believe a large swath of the population has decided to accept blatant lies as unimpeachable gospel as long as those lies support their desired outcomes. This same group will say anything, do anything, and sacrifice anyone to gain and hold power over those they fear or despise.

Those with power play on the fears of those who want power. Those who want power, even false power, reach out toward the lies told with open arms and embrace it as if it were manna from the lips of the God they pretend to worship. When you listen to them justify their stance and reasoning, it is difficult not to weep or shake them until their necks snap. When you question them, and all you get is soundbites with zero truth, zero logic, and even less real-life foundation, it is nearly impossible not to scream at them, “You are a fecking idiot!”

We are a land of terrified White Men who see the world they once knew changing and who are willing to do anything, up to and including giving away democracy. What is fascinating and terrible about this is that most of those White Men are poor, under-educated, and under-employed. Truthfully, they are no better off and in some cases, worse off than the people they despise. What they know is that their hero has promised them a better, whiter world where they will thrive because they will once again be at the top of the food chain.

He has promised them a world where they are Kings once more. A world where they aren’t competing with Women, Black people, Hispanic people, Asian people, or any other Vermin. He has promised them a world where their sperm is safe, and they are free to impregnate without consequence. He has promised them a world where their insufficiencies will be rewarded without question. He has promised them a world where they are free to shoot to kill without paying a price for their fear of others. He has promised them a world where their ignorance, hate, greed, and inconsequential contributions to the betterment of society matter and everyone else’s lives will not.

He has promised them paradise.

Naturally, they are so ignorant they are incapable of reading between the lines of his rhetoric. What is truly stunning? His most devoted are nothing to him; they are cannon fodder in his war against the United States, against the Constitution, against democracy. They are nothing more than money to feed his never-ending need to pay his lawyers. But they don’t care; they just keep giving and giving as if a self-proclaimed billionaire would need their last $5.

Four indictments and ninety-one counts. It’s a witch hunt.

Business fraud? They lied and cheated; it’s a witch hunt.

Sexual molestation, guilty! They lied; it’s a witch hunt.

Nevermind their God-Hero worships the very worst autocrats and dictators of this century and the last. That he quotes them and exchanges love letters with them. He had friendly meetings with them before, during, and after his first presidency. Well, for some reason, his worshippers seem to think this makes him all that much more worthy of respect and worship.

I sometimes sit in disbelief and wonder what the Hell is wrong with these people, these pseudo-Christian pretend patriots. What in all God’s love happened to them that made them go this wrong?

I have no answer. I only know this. The soul of this nation is on the line, and these people have lost their way; from the top down, they have sold their souls to power and are willing to sell this nation into Hell to keep it.

I know this, we are in a fight for our lives and our freedom. We cannot afford silence. We cannot afford complacency. We cannot afford to sit back and laugh at the ignorance of those on the other side any longer. It easy to hope the Devil will be found guilty of at least some of the charges brought against him. That hope isn’t enough to keep him off the ballot or out of the White House.

It is easy to complain about the age of Joe Biden or that you didn’t get everything you wanted in this administration. Okay, so what! That is what democracy is: negotiation and compromise all day and every day. I can only say this, maybe if more of you got out and voted at the local level and for every single mid-term, Joe Biden would have gotten more done.

Here is my one truth. I am terrified for my children, for my grandchildren and for all the young people I see every day at the High School behind my house. What kind of nation will we leave them if we don’t fight?

Level the Field

soapboxpileAre the members of the GOP both of the above? It is a fair question in light of their actions and active participation in the attempted coup by Donald J. Trump, outgoing President of the United States and his team of legal geniuses. What is there to say about those who took the following Oath:

“I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.”

It is such a simple thing; just pick the very first line thing in the Oath; support and defend the Constitution. Not a person, not a party but the Constitution of the United States. The interesting thing about this is that the incoming President and Vice President swear similar oaths of office to protect and defend the United States’ Constitution.

So what we have is a conundrum.

Is the GOP’s entire elected membership, with very few exceptions nationwide, seditious, oath-breaking, villains?  Or are they simply brainwashed cult members ready to die on Trump’s bonfire of vanity?

That is the question we have to ask ourselves as we watch the nation tear itself apart on falsehood and conspiracy theories so farfetched even those telling the stories cannot maintain their equilibrium. There is a pervasive sickness infecting not just those at the bottom but also those at the top. Elected officials willing to turn a blind eye to the erosion of traditional norms, ready to break the rules bound by centuries of standards simply to appease a single man, his temper and his apparent hold on the perceived base of voters easily swayed. I have watched Congress members say without blinking an eye what has been done in the past is not relevant today; time and again, norms are no longer valid.

Senator McConnell is not wrong; close votes are not unusual where he goes off the rails is the pandering nonsense that these require courts to decide. What is staggering is we suddenly must wait for states to certify elections before the GOP leadership will acknowledge Joe Biden as the President-Elect.  It should be noted, Donald J. Trump had already declared himself the winner on November 3. Laying the groundwork for what was to come, weeks of nonsensical legal filings in various states that went nowhere fast. Weeks of news conferences from washed-up has-been sycophants spewing unsupported claims of voter fraud, with guarantees their master would be king come January.

What have we learned from all of this? What can we take forward into the future?

One thing we should learn is what comes around goes around, always. If you don’t like the polarization of Washington, D.C and the partisanship of politics today, blame Harry Reid and the Senate Democrats of 2013. The Nuclear Option eliminated the Senate filibuster for all nominations to Article III Federal Judiciary except for the Supreme Court and the President’s picks for his Cabinet. This led the way for Mitch McConnel to pack the federal judiciary with 300 unqualified lifetime appointments and three Supreme Court Justices. Additionally, it allowed the Trump administration to select uniquely unqualified members for his Cabinet, including his own children, without a single protest in the Senate. Finally, as we look at Joe Biden taking office next year and the Cabinet he is putting together, the GOP Senate members are already raising their hands and saying that they will not be approved despite their qualifications.

What else should we learn? What we have relied upon as traditional norms must become hard and fast rules with consequences. That we must demand more of those who sit in the oval office or walk the halls of Congress as elected leaders. We must look closely at our minimum standards; we must raise the bar and codify some of what we have considered ‘norms’ into Trump-visits-St-Johns-Churchbasic job requirements. Our future must never see another person so utterly unprepared and ill-equipped as Donald J. Trump sworn into the Presidency. We can never again allow the last four years to be repeated; honestly, we can never again allow the previous twelve years to be repeated.  Make no mistake, the polarization and partisanship began when Mitch McConnell uttered this famous phrase, signally the top GOP priority under the Obama administration:

“The single most important thing we want to achieve is for President Obama to be a one-term president.” October 23, 2010

How do we address these issues? What can we do to turn the tide for a future that looks more like the one intended by the original Constitution and in the Federalist Papers?  Despite the entire Biden presidency is a lame-duck administration, there is much that can be done. Even with a pandemic looming and an economy failing, both at home and globally, some steps can be taken that I believe could gain bipartisan support. Despite all the evidence, I remain hopeful that Republicans remain in Congress who want a better tomorrow and save America. I think what comes next is in the hands of the people, not the government. What we demand will become the priorities in Congress.

  1. Term Limits on Congress, maximum of 3 terms for both House and Senate.
  2. Change in Lifetime appointments to a maximum of 25-year for all Federal Bench. All appointments must pass a minimum of Qualified by the ABA to be considered.
  3. Change in use of Executive Orders. All Executive Orders should be subject to review by Congress.
  4. New laws enshrining ‘norms’ (e.g., the release of 10 years of taxes, health records including a phycological test, requirement to quit all business interest before taking office, strengthening emoluments clause, strengthening nepotism clauses). These new rules must include the President, Vice President and all members of Congress. These must not be a wish list but instead requirements for the office.
  5. Reversal of Citizen United. Congress to pass legislation to include all campaigns limited in fund raising activities. A gentle reminder, money is the root of most evil and there should be limits.
  6. Reinstate the Fairness Doctrine with teeth. Let’s start holding the media, including social media, accountable.

biden_HarrisThat is it for me as a starting position. I know there is plenty to keep them busy in the first 100 days. There is more to keep them busy bickering and backbiting going forward after that. Yet, we the people have the power and we the people must demand a better nation. If we want the big stuff to get done, we must demand that they start changing the rules in our favor.

Next Up, Heal or Revenge

Soapbox LogoWe have a long history of partisanship within our state and federal legislatures’, power begets power. Those with power want to hold on and those without power snivel, whine and plan their next move. This is the way of the world since history began to be recorded; it is undoubtedly the way of the Divided States of America. The one thing missing from the above? We the people, we seem to be the silent and all too frequently forgotten victims of the one-upmanship and gameplaying that takes place in the halls of power.

Donald J. Trump is the consummation of fifty years of GOP scheming and planning. He is the payoff of Right-Wing backroom deal-making. He is everything they hoped for and more because he is ignorant of their manipulation and takes credit for each disaster as if it were a success. The Federalist Society has all they could wish for, a Judiciary that leans right from top to bottom. In the final two years of his Presidency, Mitch McConnel blocked Obama’s nominations, resulting in over 100 open seats to fill when Trump entered office. What did Trump have to say?  He found his predecessor must have been complacent (lazy) in nominating despite McConnel’s very public obstructionism. We focus on the Merrick Garland Supreme Court nomination, but in truth, the Republican majority under McConnel had created a contentious do-nothing process long before this; in fact, it started from the moment they took control of the Senate.

With our national election today and the potential of Joe Biden winning, the question must be asked, what will we do if we win it all? What is in store for America and its citizens if we pull off a complete annihilation of the Republicans and what they have stood for? What will happen if there is a full power shift, the White House and both houses of Congress belong to the Democrats in January. If recent days events are any indication, violence will escalate, and this President has no intention of going quietly. We should not expect a peaceful transition of power. Truthfully, I do not expect this President to accept a loss. I expect there to be multiple challenges between now and December, if not beyond.

Nevertheless, this is about what we will do and what we expect those we elected to power to do? Will we become crazed in our victory? Will we revenge-destruction-health-life-symbolized-word-revenge-hammer-to-show-negative-aspect-revenge-d-revenge-173790748demand revenge? Will we escalate the cancel culture and just like the current administration demand, all our political enemies be ‘locked up’ for real and perceived crimes.

Will we punish our rivals and gloat in our victory? Will we become what we have despised? Demanding the Democrats in power ‘grow’ backbones?

I ask these questions in both curiosity and fear. As cities board up in preparation for election night violence, walls are built to surround Layfette Square and the White House; this isn’t the country I know, even during previous times of deep unrest.  As this President spends his time complaining about how unfair it all is, he would be winning if it weren’t for COVID, he says. As he abandons his supporters freezing in dark fields after his events, this isn’t the behavior of a true leader. This truly isn’t the nation I knew once upon a time.

Our history of protest is long and storied. From the Germantown Quakers of 1688 and their written protest against slavery to today and the Black Lives Matter protests in every major city of this nation. Some have ended in violence, some have continued for years before moving us toward a more perfect union. Each though had a purpose; each had supporters and naysayers as well. Never in our history has there been a President who has actively called for violence against protestors as this one has done. Don’t mistake me. Many protests have ended in violence. Much of that violence was sanctioned by the state and done by police and National Guard. This President, though, encourages violence by those who are simply citizens with guns and MAGA hats.

So I ask again, should we win it all, what will we do? Who will we be after that euphoria wears off and we are done dancing in the streets from joy; who will we be in our victory? We will have a choice. We will only have four years with Joe Biden at the helm of the Presidency and then we will go dancinginstreetthrough this again. Perhaps Kamala Harris will run, maybe not. If the Democrats get the next two years right, they will hold onto both houses of Congress and there will be no divided government during Biden’s tenure in the White House. If they get it really right, come 2025, we will have a shoo-in for the next 8 years.

What should we be? In my mind, we should play the long-game, and we should be focused on the American people and healing the nation. We should ignore the petty revenge scenarios. We should forget the nonsense of who did what to whom. We should be focused on fixing what is broken for all of America and what can be done now. Here would be my plan for America if I could sit with Joe and Kamala for just a few hours:

  1. Focus on the pandemic, get the resources to the states first and work with the Governors on practical test, track and trace plans. Pull all the Federal Emergency Response levers to make available to state and local governments all necessary resources. Finally, work with Congress to shape the right Bill and pass it through both Houses to get the necessary resources into the hands of individuals, state and local governments to keep everyone whole while we get the virus under control.
  2. Form a bipartisan committee to look at the entire Article III Judiciary branch, including currently seated judges, the nomination process, qualifications, confirmation process. I want everything looked at. I also want to assess current acts, behaviors and actions of current seated Judges and Justices where there is anything questionable. This committee has 120 days to return their initial review and recommendations; if there are specific issues that require additional assessment, they must include these in their initial report. This report will be entirely transparent and made public.
  3. No Senators from either party to be named to Cabinet seats; Joe Biden cannot afford to name any Democrat to a Cabinet seat even if he wins, and the Senate returns to Blue, it will be by a small margin. Rather than ‘play’ favorites, simply put a moratorium on the entire Senate and leave all elected members in place.
  4. Form a bipartisan committee of Black Lives Matter Community Restoration and place VP Kamala Harris in charge. Give them 120 days to produce an initial plan of actionable priorities that can be taken to Congress. This should be a citizen committee but should also have sponsorship from both House and Senate so Bills can be produced quickly from the actionable priorities.
  5. Form a bipartisan committee of Police and Justice Reform. This group will need to include citizens, police, educators in the field, and others with specific knowledge in the area. Were it me, I would put Jeh Johnson at the head of this one; he is clear-eyed and clear-headed. This one would have 150 days for the initial analysis and report. I give them a bit longer because they must look at two separate and very unequal parts of our system. Policing and Justice, while intertwined, remain separated by layers of implementation. Ultimately we have to consider all the individual layers of Federal, State, Local and overall Justice Reform if we are to truly ‘fix’ what is broken today.

Those would be my first day in office; those committees are formed and off to the races. Are there other pressing issues? Certainly, there are and they would have to be taken on post-haste. This nation needs so many things, Joe Biden Accepts Presidential Nomination At Democratic National Conventionso much healing. Each item seems to be a priority. But if we could at least seem to be moving toward action, that is something. Gloating and revenge doesn’t heal us; it might give us a momentary thrill, it might make us feel good for a minute or two, but it does not heal us as a nation and healing the nation is what we most need now.

So I ask one more time, who will we be, should we win it all? Will we emulate the Administration of the past four years? Will we be monsters? Or will we be something finer, something more generous, and begin the hard work of healing.

On the Bench

Lepore-RBGpostscriptShe is the Federalist Society’s darling, and for excellent reason, she is by far one of the purest Constitutional Originalists I have read in over thirty years. She goes much further than her mentor Scalia ever did in his interpretations. She absolutely terrifies me, in part because she is bright, pragmatic but even more, she is an absolute ideologue. She hides it well; she dances brilliantly. Still, it is there, and she is the antithesis of everything Ruth Bader Ginsberg stood for. Yet after hearings that were polite and without real merit, Lindsey Graham, without qualms and without a full committee, pushed her nomination to the full Senate for a vote that will be taken on Monday 26 October 2020. For those of you that are counting, that is six days before the next president’s election. She will be the next Justice unless some GOP members of the Senate find their moral backbone and say NO to Donald Trump, Mitch McConnell and the rest of the spineless enablers and say YES to the American People.

Just to make clear, I am not an Attorney and have no formal legal training. What I have is decades of watching the court in action and reading legal briefs and scholarship. It is an interest of mine. Do I get it perfectly? Absolutely not. So for those of you who know more than me, feel free to correct my understanding. What follows is simply my understanding of what I have seen and been able to discover of Judge Amy Coney Barrett.

I watched three days of hearings before the Republican-led Senate Judicial Committee. Farcical is the most polite term I can come up with. Three days of Republicans, grandstanding, campaigning and praising her laundry skills, mothering skills and, of course, the brilliance of her legal mind as an afterthought. The comparisons to Ruth Bader Ginsberg were, for most of us, insulting. She is not now and will never be, except perhaps in the mind of the Federalist Society and those who put her on the highest court in the land, comparable to the Notorious RBG. The truth of the matter, Amy Coney Barrett, is the dream jurist of the Right and a nightmare for the rest of us. Most notable for me and many others were three items she would not commit her ‘brilliant’ legal mind too:

  • A president could not unilaterally change or delay an election.
  • Voter intimidation is illegal under any circumstance.
  • A president cannot pardon himself.

Add to the above, when pushed by several Senators on recusal, she refused to commit. Despite the president’s public statements of his reason for fast-tracking her nomination, his desire to have her on the bench to tip the balance in his favor when he challenges the election outcome should he lose. 

It is difficult to truly explore Judge Barrett’s legal thinking. She has only Prof_Amy_Coney_Barrett_2_10been on the Seventh Circuit Court of Appeals since October 2017, three (3) years. Prior to her short time on the bench, she was a Professor of Law; much of her time in this role was spent at Notre Dame, where her published writings are protected. Her limited exposure to litigation was in private practice, with the only notable case being as research assistant on Bush v. Gore. She never argued a case, certainly not in front of the Supreme Court. I do not want to entirely dismiss her; she clerked on both the Court of Appeals and the Supreme Court. She has earned a great deal of praise for her research, writing and teaching. She is beloved by her students. However, none of this makes her ready for prime time; none of this makes her a worthy inheritor of the seat left vacant by Ruth Bader Ginsberg.

Consider some of her available publications first; one that stood out for me was Catholic Judges in Capital Cases. While there were no surprises, there was a significant discussion surrounding the loyalty owed to the Church and its teachings. There wasn’t a suggestion that the judge should ever attempt to align the law to the Church, but that their moral behavior must align instead; ultimately, where the two did not or could not recusal was the answer. What does this mean in cases she might hear in the future? Either she will ignore her own advice, or she pushes the agenda, we all believe she has. Areas where the Church and the law are out of alignment? Abortion, IVF, several Civil Rights areas, including protections for LGBTQ people (e.g., housing, medical services, marriage, adoption). What is her answer? She has said she can judge without bias; however, I have to ask the question based on this single item. Is she?

The next read for me was actually three separate essays written over five (5) years on the subject of Stare Decisis[1]. The Stare Decisis doctrine directs the court to stand by the established precedent set by the court. The court rarely overturns its own precedent, though it has, in some cases, which signifies it has a new way of looking at a legal issue that has been presented. Based on her writing, though, it seems she is only supportive of courts and judges taking the initiative of ignoring precedent when that precedent is not aligned with the court or the judge’s thinking. It is frankly a very murky area. An example of a previous court ignoring precedent is Brown v. The Board of Education (1954), where the Separate but Equal doctrine established in Plessy v. Ferguson (1896) was ultimately overturned. This is an example where a Super Precedent existed and was challenged. During her hearings before the Judicial Committee, she would not say whether she agreed with the Brown decision.

Judge Barrett says she does not believe Roe v. Wade is a super precedent simply because of the number of challenges. For an interesting read on precedents and super precedents, try this one, which provides an overview of how we should view them[2]. The reality is it would be inconvenient for Judge Barrett to view Roe as a super precedent, just as it would be inconvenient for her to recuse from the ACA battle that will be her first Court case on being seated. She has written more than once regarding the ACA and has even taken issue with a decision by Justice Roberts to uphold the ACA.

In my reading, I found a common theme in Judge Barrett’s view of the courts’ ability to create common law[3], even overruling legislative authority. I was fascinated by this view as it derives from her reading of the Constitution and her ‘Originalist’ stance. While I think we all agree, we have separate but equal branches of government, each with their own powers, now we have a nominee who will shortly be seated on the highest court view that court with the ability to legislate from the bench. In my opinion, she puts us all in great jeopardy.

I have had several discussions about Judge Barrett since her nomination. In my mind, her own words condemn her. Listen to what she said in 2016 at the death of Antonin Scalia. I believe those we put on the Supreme Court should not only be legally able, but they should also be morally and ethically sound. Someone said Presidents serve for 4 years, not 3, and certainly not 5. Her nomination extends the current term of Donald J. Trump to five years, even if he is by some terrible chance re-elected her nomination and confirmation should wait until after November 3.

If she had an ounce of moral fiber, she would withdraw herself until after the elections.
