Pursuit of Rights

OpEdThe world has lost its way; this nation in particular has lost its intent though we should always be wary of setting our sights too high on a moral standard that never truly existed. I was originally going to write in one pithy piece to show, historically the truth vs. myth of this nation. I found though, there is simply too much information to write one piece, too many pivot points where we might have done the right thing and choose differently. Because of social media we can now see daily what has been before us all along. We are witness to the casual violence entwined through our cultural foundation and accepted as normal, even sometimes encouraged as necessary. We, this nation in particular, we have lost our way at every level that is important.

While the Founding Fathers and those who supported their intent certainly had a desire for ‘freedom’ it did not extend beyond themselves or their narrow worldview at the time. Despite the high-flaunting words of the documents that continue to define us today, (e.g. Declaration of Independence, Constitution of the United States of America, Federalist Papers), there was never any though that ‘all men’ had the ‘right to life, liberty and the pursuit of happiness’. What they meant was, White Men, men of European ancestry, men of property and means. Certainly, there was never a thought regarding the idea that ‘men’ might be a more inclusive term, might embrace ‘all men’ and even women.

The nation, that is the US of A, these divided states, this unfortunate collection of frightened and poorly led humans distributed across masses of land with lines in earth and names drawn from the language of the indigenous people the European invader cheated, robbed, hunted, tortured, murdered and kidnapped. This unfortunate nation, led down paths of patriotism through fear to a misguided belief we are or should be the moral police of the world; that we have an obligation, an edict from God to direct others to do what we ourselves have failed so miserably at within our own land.

What do we think we are directed to do, what is our Manifest Destiny?

To lead other nations to Democracy and even hallelujah Christianity, Amen and pass rocket launcher.

What have we failed at, do you truly ask this or are you simply curious what I believe our failure as a nation is? I will try to be succinct, I promise you. We lie to ourselves, the most obvious and is when anyone, whether politician or man on the street says stupid things such as:

“America is the Greatest Nation in the World.”

No, no we are not the Greatest Nation in the World. In fact, we are far from the Greatest.

In fact, we did not make the Top 10 on any ‘Best’ list.

We did not make the top of any lists, except these:

This isn’t anything to be proud of, is it? We aren’t doing a great job of building on the foundation laid by our forefathers, those visionaries of the American Dream, or are we? Shall we take just a moment to consider some of their more important contributions to infamy and how we are living up to it even now, nearly two hundred and fifty years later.

  • Slavery — yes this is a good one, the nation was built on the backs of stolen lives, stolen from the continent of Africa, stolen from the arms of mothers and fathers, stolen from their culture and homes; simply stolen. The first slaves were sold into a lifetime of servitude and misery in Jamestown, Virginia in 1619. These ’20 odd’ human beings were the beginning of the end for the nations soul. Here is a bit of history for you, want more go here:
    • 1705, Virginia codifies Slave laws some of which you might recognize today: All non-Christian servants entering the colony are slaves, all slaves are real estate, masters who kill slaves during punishment are acquitted, slaves and free colored persons are forbidden from assaulting a white person, slaves are forbidden the right bear arms or move freely without written permission.
    • 1740, South Carolina passes a comprehensive “Negro Act,” making it illegal for slaves to move abroad, assemble in groups, raise food, earn money and learn to read English. Owners may kill rebellious slaves.
    • 1788, the new nation adopts the Constitution including Article I, which reads in part as follows:
      • ……adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons….
    • 1819, Virginia outlaws, whether free or slave all blacks and mulattos, from meeting for the purposes of education and forbids teaching blacks to read and write.
    • 1837, free Blacks in Pennsylvania and Mississippi lose the right to vote. In New York, they petition for continued voting rights.
    • 1857, SCOTUS renders the Dred Scott decision denying citizenship to all slaves, ex-slaves and descendants of slaves, further denies Congress the right to prohibit slavery in the territories.
    • 1865, Thirteenth Amendment is signed abolishing Slavery throughout the nation.
    • 1866, the Klu Klux Klan is founded in Tennessee
    • 1881, Tennessee passes the first of the Jim Crow segregation laws other states follow and the era of Reconstruction is ended less than a decade after Slavery officially ends in these United States.

A few things to consider in the much-shortened timeline above, Article 1 of the Constitution has never been repealed or changed by Amendment. Though many like to think the Thirteenth Amendment emasculated Article 1 and the Three Fifths counting rule of Blacks held in slavery and ‘others’, the fact is Article 1 remains intact.

Something else to consider as we approach mid-term elections, The Dred Scott decision which in part read as follows;dred_scott

” . . . We think they [people of African ancestry] are . . . not included, and were not intended to be included, under the word “citizens” in the Constitution, and can therefore claim none of the rights and privileges which that instrument provides for and secures to citizens of the United States. . . .” Chief Justice Roger B. Taney, speaking for the majority

The Founding Fathers failed fundamentally in their vision, they failed to understand ‘all men are created equal’ should have meant just that, should have been an inclusive statement if they wanted to achieve their goals. Instead, they built a nation whose cornerstone was bathed in the misery and blood of slaves, not equality, not freedom and certainly not the pursuit of happiness for all men. This touches only on the issues of Blacks in America, I have not dived into the theft of land, destruction of culture and murder of an entire indigenous people, tell me again how you discover a land already populated by millions.

Want to be part of change? Vote. Get up and Vote. Don’t believe what they tell you, Vote. Don’t let your voice be silenced, Vote. We can no longer afford to have more than half our citizens treated as if they do not count, be part of the change, Vote. Save a life, save a child and save a future; Vote.

Peeking Out of My Cave, P1

soapboxpileThis has been a bad week for humanity; let’s face it this has been a bad week no matter where on the political spectrum we fall. For some of us, for those of us who were hoping to see sanity in Washington it has been worse even than we expected. I will admit it, I have had a difficult time taking this week in, not just the national scene but some of the local sheer ugliness has caused me to rock back on my heels and question, what the hell really just what in the hell.

I spent part of the later of the week on Facebook, this time though I didn’t spend it doing one of my past favorite things; arguing with Azzhats. No this week I spent it simply deleting them, unless they were family members. I find I no longer have the energy or inclination to try to pull the curtain back on ignorance with pithy comments to Right Wing Meme’s on Guns, Immigration, Abortion or any combination of same, nope this week fly across my line of sight with some ignorant lack of compassion and I simply deleted you forever, bye-bye .

For the most part though, I have stayed silent allowing the horror of the week to sink in, allowing my heart and my mind to wrap itself around all of it and absorb it. So often we react, lash out in anger and pain, we fail to consider the consequences, on friends or ourselves. So, I sat and listened to others including the idiots in the media, everyone seemed to have an opinion or a source, most of them were bad or ugly or both. I did a great deal of reading, my apologies if I didn’t get to you this week, my energy seemed to be flagging, between all the horror in the broader world and what I simply couldn’t avoid closer to home, I thought it would be better for me and maybe for you if I just crawled into my cave with the lights out.

There are times when the world crashes in on us and it is impossible to escape, impossible not to react without fury, heartbreak, or both. This week the horror stories crashed like waves pounding a beach, one after another without it seemed a break. For every wave that crashed it seemed there was some pundit or politician with something to say, rarely anything positive, uplifting or in many cases true mind you just something to say. If it wasn’t the politicians capitalizing on tragedy or the media bloviating continuously and without purpose, it was the ignoramus Azzhats from both sides of the spectrum making pointless accusations, blowing up already terrible tragedies, pointing fingers or celebrating insanity.

I peeked out of my cave, I gnashed my teeth and frankly, I wept for us all before pulling my head back in and turning the lights off.

The week started for me watching the Dallas Police chase a murderous fool with a gun. Through city streets, he drove his car leading a chase, occasionally shooting at police. Why was this so interesting? This worthless piece of humanity had just shot his soon to give birth girlfriend, the result of his action – he was captured after crashing his car and running into an abandoned house. Unfortunately, both his girlfriend and her unborn child lost their lives, her because of the gunshot and the baby due to oxygen starvation before the doctors could intervene. I met a friend of this young woman’s the following day at a Starbucks I stop at coffee for each day, I listened to the horror of that day for her and the family who had waited at the hospital. The horror as they prayed for a different outcome. All I could do, as I cried with her is hand her my card, offer comfort and silently damn a nation that will not do more to protect us.

justice

Their story was overshadowed by the Boston Marathon, the lost lives, the horror of the runners who lost limbs. The fear and terror of random violence in what should have been a moment of great triumph for so many. I watched with great pride in my fellow men and women as they ran toward the terror to help others, there are still heroes in this world. I watched Boston respond I was lifted up.

Then came the shit storm, from all sides then came the speculation and the jumping to conclusions and stirring the pot to get a rise out of already highly charged emotions. Maybe I am just overly sensitive, maybe I have a high Bullshit meter, but really why do politicians, pundits and talking heads have to flap their lips when they truly have no information other than their own fears, prejudice and ignorance to guide them, I only want to know. Why is the best we can hope for from our fellow human beings is picture after picture of another human beings terrible injuries, horrific suffering? Why is this the first thing, sometimes the only thing shown along with the accusations of the perpetrators being “Dark Skinned Males“, long before anything was known.

Terrorist Attack – yes, because it created terror in the population

Is anyone aware of who else committed Terrorist Attacks on US Soil?

Timothy McVeigh – Oklahoma City Bomber, 168 people dead, 800 injured. Race: White, Religion: Roman Catholic

Terry Nicols –Oklahoma City Bomber, 168 people dead, 800 injured. Race: White, Religion: Christian

Ted Kaczynski – Unabomber, 3 dead, 11 injured in multiple attacks. Race: White, Religion: Agnostic

Want to know what all of the above have in common, other than being murderers on the Terrorist side of the house, Enemies of the State and if you believe in Hell either already there (Timothy McVeigh) or on their way. Well, let me tell you they were all Mirandized at their arrest, they were all given due process of the law based on our Constitution, they were all presumed “Innocent Until Proven Guilty”.

Dzhokhar Tsarnaev – Boston Marathon Bomber Suspect, 4 dead (includes officer at MIT), 140+ injured. Race: White, Religion: Islam, Citizenship: USA

What is the difference? Oh, yeah there it is, he is not a Christian! Certainly, his crime isn’t up there with Terrorist Duo Timothy and Terry. Do not misunderstand me, what Dzhokhar and his brother are suspected of is terrible, what they are accused of perpetuating against innocent people is an act of terror. I do not excuse this, not by any means. Nevertheless, since when do we suspend our Constitution, our fundamental rights simply as a convenience? Again and in stronger language, WTF! He is a nineteen-year-old kid, we don’t need to suspend his rights he is alone in the world, injured and scared. No matter the crime, no matter the heinous act this is still last, I checked the United States of America and we still are a nation of Laws, we are still all afforded the “innocent until proven guilty” rule, aren’t we?

I weep for all of us. I weep for our disintegration. I weep for our willingness to turn our backs when the suspect is not like us. I weep that we are willing to cheer this suspension of law.

I ask you all, what is next?Kickm

Stay tuned, I will take on the rest of the week in the news later.

Hard Stop Sanity

If I haven’t visited you lately I apologize, I had a very difficult time processing my feelings after the tragedy of Sandy Hook Elementary this past Friday. I have watched social media for the week, watched friends and family make their personal stands on the issues of gun control, mental health and a host of other surrounding issues. This is a disclaimer, I am not a mental health expert, I am not an expert on the Constitution nor am I an expert on all the issues surrounding firearms, murder rates or suicide. I am a parent and a grandparent, I am a victim of violent crime, I am a survivor of domestic violence and I am a citizen of the United States. I care about living in a civil and sane society in the future and I care about the future of my children and grandchildren.

_____________________________________________________________________________________

At what point, then, is the approach of danger to be expected? I answer, If it ever reach us it must spring up amongst us; it cannot come from abroad. If destruction be our lot we must ourselves be its author and finisher. As a nation of freemen we must live through all time, or die by suicide.

Abraham Lincoln, Young Men’s Lyceum of Springfield, Illinois January 27, 1838

We are complicit through our inaction, through our fear and our refusal to acknowledge the issues we create through greed, ignorance and ideology. Yes, I said it we created the Hell that sees our children dying in their classrooms, in the streets, in the mall. We are responsible for this mayhem, this chaos this vicious cycle.

We are a nation of paranoids, a nation of victims wrapped in flags with Bibles in one hand and high capacity military grade weapons in the other. What are we afraid of? Oh sure, the government is tyrannical and somehow we must protect ourselves (hint: even with the weapons you have they have better ones). Of course, you need these high capacity clips and assault weapons to defend your home (hint: if you have fired 100 rounds in 30 seconds Bible&Gunsyou have likely killed your own family along with the bad guys and if they aren’t down you aren’t getting out alive).

We should not be quick to jump to conclusions, we should not be quick to slap that ‘insanity’ label on giving us the excuse to wipe our hands and carry on with our mundane lives. The truth is, most spree murderers are not clinically ‘insane’, do not have long-term psychiatric problems and are not psychotic. The make-up of the mass murder is changing, what isn’t changing is access to high-capacity magazines and military guns making the death toll higher.

The meme of those who demand their Second Amendment rights remain sacrosanct:

  • Guns don’t kill people Kill
  • 64,999,987 legal gun owners killed no one yesterday
  • Know guns, know peace and safety. No guns, no peace nor safety.
  • Gun control is hitting what you aim at.
  • The right to buy weapons is the right to be free.

Don’t you just love some of those? Yeah, me too they make me all warm and fuzzy; not.

In light of the tragedies of recent years, does the above stupidity hold weight? Can we honestly stand aside and allow our nation to continue to hold the record for death by gun violence among other high income nations, is this what we should be proud of?

Just a small slice

Just a small slice

I am pragmatic; the monster is already out of the box. We cannot fix what is already so tragically broken. We cannot change the minds or hearts of those who believe the only way to a Civil society is by arming themselves, arming school teachers, arming college students in their classrooms and dorms. We cannot change a society convinced they must be armed to the teeth, in their homes, their cars and walking the streets to protect themselves from the government, those violent ‘others’ they heard about or the zombie apocalypse.

Let’s start with some facts; I think it is important to make this a non-partisan issue:

  • Gun owners are both ‘Liberal’ and ‘Conservative’
  • When the Constitution was written, guns were breach load muskets single shot
  • Slave and Land holders wrote the Constitution; in fact, within the first ten amendments slavery is ratified. We do occasionally see the error of our ways and correct them, the Constitution was not written on stone tables by a lightning bolt shot from on high.
  • Anyone is able to purchase any type of firearm, including military grade semi-automatic rifles and handguns without a background check or waiting period in the secondary market (gun shows and private sales, including the internet). Forty percent (40%) of all legally purchased firearms are purchased this way.
  • Anyone can purchase as much ammunition in any clip size as they want without any tracking, registration or license on the internet.
  • Approximately 10,000 people are murdered every year in gun violence, many of them teenagers.

There are those who say their right to bear arms, their right to conceal carry, their right to own any weapon and any clip size is inviolate. They say armed rebellion would be the result of any attempt at Gun Control, they say SCOTUS has confirmed their right in District of Columbia v Heller to be armed and dangerous under any and all circumstances and without restraint.

This is what I say; I say there must be some middle ground that satisfies all of us. There must be some middle ground that stops the senseless deaths of our children and the murderous rampages in our public places.

This is what I believe must happen if we are ever to begin to heal this nation:

  • Require national registration
  • Demand Conceal Carry permits only in the following circumstance and make this a federal mandate:
    • Show true need (e.g. over the road truck drivers, certain security personnel, off duty police)
    • Attend regular training
  • Require same background check and waiting period in secondary market as in gun stores
  • Create national mental health registry
  • Update criminal background check registry to include domestic violence
  • Do not allow restoration of civil rights after time-served to allow gun purchase for violent criminals
  • Update background check to include Terrorist Watch List
  • Limit Clip Size to 10 rounds
  • Do not allow private purchase without background checks, make private sales illegal even between family members
  • Shut down internet sales of ammunition
  • Require gun safes in the home of all gun owners with children under 18
  • Raise the age limit to 25 for legal purchase and gun ownership
  • Require gun safety class before purchase
  • Change Stand your Ground laws to apply only to personal property / personal homes make this federal rather than state by state
  • Create a federal buy-back program to get illegal guns off the streets of our cities, give it two (2) years. Within the scope of the buy-back program, strengthen the laws and penalties for owning an illegal gun, selling a gun illegally and for using an illegal gun in the commission of a crime.

I don’t want to take your guns. I want sanity and safety. I would rather not call it gun control, I would rather call it Gun Sanity. These days I am afraid to go to the theater, the mall or anywhere else. If you are a gun owner, frankly I am afraid of you. Is this really the world any of us want?
