Not Backward, Please

Eisenhower_and_KennedyI have been thinking, I know dangerous up there my brain wheels grinding and all.  Nevertheless, I have been thinking.  Thinking about how the world has changed in fifty years, especially the United States.  How we as a nation and a people have changed so very much in this short half-century of time that has passed since the assassination of JFK in Dallas.  Do you wonder how we have changed?  Do you think it is for the better or like me, do you think we are worse as a nation and pettier, smaller as a people.

Dwight Eisenhower warned us of some of what was to come if we allowed certain elements of our society to gain control.  In his farewell speech he said much, though one quote is often referenced it is also taken out of context, leaving off much of what President Eisenhower said and intended regarding the military-industrial complex, I recommend reading his speech.1

From this same speech comes an even more profound statement, one that looked into the future and saw the potential of our smallness.

“Another factor in maintaining balance involves the element of time. As we peer into society’s future, we – you and I, and our government – must avoid the impulse to live only for today, plundering for, for our own ease and convenience, the precious resources of tomorrow. We cannot mortgage the material assets of our grandchildren without asking the loss also of their political and spiritual heritage. We want democracy to survive for all generations to come, not to become the insolvent phantom of tomorrow.

Down the long lane of the history, yet to be written America knows that this world of ours, ever growing smaller, must avoid becoming a community of dreadful fear and hate, and be, instead, a proud confederation of mutual trust and respect.

Such a confederation must be one of equals. The weakest must come to the conference table with the same confidence as do we, protected as we are by our moral, economic, and military strength. That table, though scarred by many past frustrations, cannot be abandoned for the certain agony of the battlefield.”  1

What does this mean?  As the oldest President handed the reins of power to the youngest, he warned the nation of our potential for terrible acts.  He thanked Congress for working with him in a bipartisan manner.  He thanked the nation for allowing him to serve.

What this doesn’t tell us, we were already sending soldiers to Vietnam.  We had been doing for years though the term then was ‘advisors’.  Three weeks before the assassination of JFK, Lyndon Johnson and Secretary of Defense Robert McNamara upped the ante, increasing both military and economic support.  We were at war again, though undeclared.  This would lead to the first draft of unwilling soldiers since 1942, on December 1, 1969.

The world was in upheaval.  Young people taking to the streets, demanding they not be sent to die on foreign shores.  Demanding accountability for the billions spent, the lives destroyed and lost, the flag draped coffins shown on television every night reminded us, young and old, this was not a war of our choosing.

President Johnson decided not to seek reelection because of the outrage against Vietnam, thus handing the reins of power to Richard M. Nixon.  The nation was once again sent spinning, though he eventually ended the war, he also taught us a terrible lesson about the abuse of power.

Do we think about this, track this abuse of power in those we elect to high office?  Personally, I don’t think we do.  I think instead we shrug it off, in some cases even expect it and so continue to elect the miscreants.  One thing I know for certain.  No matter who actually commits the acts, whether criminal or simply scandalous we lay the blame at the feet of the President holding office at that time.  With this in mind, let’s take a quick look at the High Crimes and Misdemeanors of the past several administrations:

I will admit it was difficult to come up with these numbers, nearly every site listing numbers gives a slightly different view and I did not include Sex Scandals in the numbers of which we have had many over the years.  Soooo, while these numbers are close to accurate, they may be off by one or two in each administration.  What I found fascinating in looking through the lens of history?

Look at that would you, all those big ones.  What does that say to us?  The redder we get the more corrupt.  That no matter which side of the aisle congress falls on, whoever is in the White House sets the tone.  Is this why today we have a bunch of obstructionist clowns, criminals and hypocrites trying their damnedest to manufacture scandals to lay at the feet of this President and this administration? Thus far though we have many named scandals, not a single one have stuck except in the minds of those who would smear, those who would destroy a legacy, those who are so filled with hostility toward this President, they would do anything including destroy democracy and us, the American People in their crusade to destroy this administration.

Don’t mistake me, I can find fault with President Obama.  I wish he would lead us further down the progressive path, further to the left rather than sticking so closely to the middle.  I understand though, he is leading the entire nation, not just the part I belong too.  I wish he would end Afghanistan, bring our soldiers home for good.  I wish he would rein in the NSA, shutter the programs of his predecessor.  I wish he would stop the Drone attacks and the killing of civilians.  I wish, frankly he would stop negotiating with his haters and stand up for his base, lead the party and the nation with strong words and actions that call out the naysayers by name. But I understand, sometimes you have to act in the best interest of others to gain the best interest of an entire nation.

I thought though these little factoids were interesting, fifty years of High Crimes, Scandals and What the Hell in the face of a changing nation.  No, our President isn’t King, Dictator or any of the other names laid at his feet.  He also clearly isn’t leading the most corrupt administration in the past century.  The election and ultimately assassination of John F. Kennedy opened the door for so many things, including the opportunity for Barack Obama to become President someday.  Strange what fifty years will do to a nation.

I have to ask all those Conservatives, those Tea Party Republicans, those whatever on the Right you call yourself; what is it you want to take us back to anyway?  From where I sit back doesn’t look all that grand.

You Can Keep It

Everyone weights in, including Bill Clinton. Everyone has an opinion, on both sides of the aisle; Democrats and Republicans, the Tea Party is running with the idea of the Train Wreak.

The website doesn’t work as well as it should. It is certainly a problem; I think we can all agree.

Sign-up in the federal marketplace for private insurance are far below projections or what is necessary to claim success. The slow sign-up is consistent with the Massachusetts experience and reflective of the gross problems of Healthcare.gov. There are so many different issues, more than are being addressed by the media, the talking heads or by the clamoring politicians afraid of their re-election prospects.

What should we be thinking right now? Who is to blame for the failures? What are the answers?

Without pointing fingers at any single person or entity, is it possible to answer these questions? Probably not, so let’s point some fingers and remind ourselves of what the ACA was supposed to be and who is behind some of the failures and who is not.

Healthcare.gov is a website with a complex integrated system underlying it. It was underfunded, poorly managed from its onset and deployed without appropriate testing. Further to this, thanks to the many obstructionist Republican Governors who refused to establish state exchanges, the Federal exchange is far bigger than originally expected. What does this sizing mean? It means greater complexity, more integration to individual private insurance companies in individual states. Add to this the entrance barriers set up by those states that chose to ‘opt-out’.

Can we blame this entirely, no we can’t. We can point to this as part of the problem though.

We also have to blame the contractors, all of them, responsible for the design and deployment of the Healthcare.gov solution. No, not just the website the entire system; it does not work and this is a clear design flaw. The flaw isn’t just in the front-end, what you or I might see, but in the back-end everything from how it was sized to how it is integrated to the all the other systems it must integrate with to provide the services it was intended for. The contractors hired to provide this system were given a Statement of Work (SOW) to develop this system with what I am certain were clear milestones and requirements, they failed to meet the most critical of these. None of us can know for certain how oversight was provided over the various stages of the contract, how milestones were validated or whether there were periodic quality gates to insure requirements were being met. We do know though taxpayer money was paid to private contractors to deliver a system that does not work and that is doing great harm to citizens and this administration.

Does part of the blame for the system failure fall on the government agency in charge of the development? Yes, it does. They were responsible for oversight. Who within that agency is responsible? Ultimately, it is the head of the agency; however, knowing what I do about this process it is unlikely the top of the line was sitting in status report meetings, performing tests or otherwise involved in the daily activities of this project. There was an accountable deputy.

Here is what I do know, The President of the United States is not responsible for the failure of Healthcare.gov as a computer system or website frontend and we truly need to stop beating him about the head and shoulders for this specific failure.

Finally, ‘You can keep your plan if you like it’. Yes, the President said this repeatedly. I think he believed it. In fact, within ACA all the policies now being cancelled by the Private insurance carriers were grandfathered for at least two years. This means Americans should have been able to keep their policies through 2015. Let’s talk about both the junk and what else the Private market is doing shall we?

  • High deductibles
  • High co-pay
  • Annual spending limits
  • No catastrophic coverage

These were primarily Defective products, not grandfathered and in many cases, states had thrown the companies out years ago. On the other hand, there were policies that did meet the standard for being grandfathered, even if they did not meet the ‘Basic Coverage’ standard of the ACA. What is happening with these? Why are policyholders receiving letters of cancellation of policies they like, that the President of the United States promised they could keep. There is a simple answer.

The Private Insurance Carrier decided to re-price their product to ensure they were making a PROFIT.

When the ACA was designed and passed, it was a gimme to the Private Marketplace. It kept Private Insurers in the game, offering them a broader market even if they had to meet some new restrictions and regulations. Although the law was designed in favor of citizens, allowing them to keep their current policies, it cannot force the private insurer to continue offering that policy to the market.

Blaming the President for the greed of the Private Insurer is idiotic, truly stupid. For those making the most noise, I offer this tidbit to chew on. The acts of the Private Market are consistent with Capitalism at its finest.

Well this is what you got, so stop bitching. The Private Insurance marketplace is doing exactly what they choose; they are evaluating their products, cancelling those that no longer meet their profitability standards and offering alternatives. They are using marketing techniques, while you and I might find them slightly shady; there is nothing illegal about what they are doing. If those receiving the cancellation letters are too lazy, stupid or stubborn to look for alternatives; shame on them.

I am tired of hearing the ACA is a failure. We have only gotten started and even today, with what has already been implemented it has helped Americans. Do we need to look at the ACA and potentially tweak the law? Yes, we do and we should. But this trash talk in Congress, on the street and in the media is ignorant and without merit.

I cannot begin to tell you all how tired I am of hearing about Healthcare.gov and all of the glitches. Yes, I get it, really I do. It is hinky, the roll out was not seamless and smooth, it is well let’s just say it is imperfect.

It is in fact an ugly baby.

What Healthcare.gov is not; it is not the Patient Protection and Affordable Care Act (ACA). Healthcare.gov is simply a delivery vehicle, one of many and one that is currently not performing as it should but it is not the law itself. Democrats on the Hell  Hill, pundits in the media and all of us truly need to separate the two and discuss them as distinct and not at all equal. It is contingent upon those of us who support the idea of access to affordable Health Insurance for all citizens that we not confuse or confabulate the issues surrounding the ACA (aka: Obamacare) and the rollout of one hinky delivery system, Healthcare.gov.

All this being said, let’s first talk about some of the idiotic conspiracy theories first. Don’t think they exist? You don’t read the Right Wing My Head is Exploding with all my f’ng insider knowledge, do you? So, here are a few of my recent favorites, those Right Wing walks resulting in False Equivalency that eventually makes their way into the mainstream because everyone is afraid to call Bullshit:

  • No bid contract awarded to CGI, the Canadian corporation, prime contractor.
    • Since 2007 CGI has had an ID/IQ designation with the Department of Health and Human Services (DHHS). The designation means Indefinite Delivery, Indefinite Quantity and covers contracts from $1K to $4B. CGI is one of 16 companies granted this designation prior to President Obama’s first term. These designations are consistent throughout the government, whether they are appropriate or not is a different issue. (sourced from various sites including DHHS). It is possible, though not probable some work orders for Healthcare.gov were awarded under this designation. It should be noted however, CGI was not the only vendor working on the Healthcare.gov integrated solution.
    • Further, on various sites (no confirmation yet) the RFP (Request for Proposal) was sent to several qualified vendors. DHHS received four (4) responses and of these, only CGI’s response was reviewed and accepted (again no confirmation of the veracity of this statement). There is only one reason why other responses would have been rejected without review; the response did not meet the stated requirements of the RFP.
  • Senior Vice President of CGI Federal, Toni Towne-Whitley was a Princeton classmate, class of ’85 of First Lady Michelle Obama and is a member of the Princeton Black Alumni.
    • Yes, both of these statements are true on their surface. Careful examination of some facts would find though, it is unlikely they are friends or ever met each other at school. They traveled in different circles, attended different schools at Princeton with different educational goals and attainments. Simply attending the same very large school does not instantly mean you know each other. By the way, Daily Caller, not every Black Person in the country knows every other Black Person in the country.
  • Upon award of the contract to CGI the President of CGI Group, George Schindler donated to the President’s reelection campaign.
    • Yes, in fact he did, $1,000; big money there. Mr. Schindler also donated to Mitt Romney and previously he had donated the max of $2,300 to John McCain. To make this easier though, let’s just debunk all of this and go ahead on to Open Secrets if you are interested. Follow the money, use the following criteria;
      • CGI
      • George Schindler
      • CGI Technologies and Solutions, Inc. PAC
      • Toni Townes-Whitley
  • The cost of Healthcare.gov was somewhere in the neighborhood of $693M.
    • No, no it was not anywhere close to this. In fact, the awarded contract was approximately $70M originally, when you factor in all the changes required due to recalcitrant GOP Governors who refused to implement their own state marketplaces, the final cost might be closer to $115M. The final costs are not in, however Daily Kos have done an excellent job of pulling apart the Right’s argument with facts here, including a great spreadsheet here.  I love facts!

Now, those are my favorites of the weekend. Really, how hard is it to stick with facts and stop making shite up?

Can we talk for a minute about what Healthcare.gov is and what it is not? I don’t want to bore you with tech-speak; I do some of this for a living and even my eyes glaze over. I do want to talk about what Healthcare.gov is and why the idiots on the Hill should not be holding hearings over which they have not a clue.

  1. Healthcare.gov is not a simple website. The website is a frontend; it is how you and I access the system behind it.
  2. Healthcare.gov is an integrated system. This system requires tens of thousands, if not millions of lines of custom code to parse information you and I enter, including our names, address, financial status, this determines what products to show us. This is essentially “If, Then, What” lines of code based on multiple options. Then, once the products we qualify for are delivered to our screen and we have the opportunity to review and decide this same solution must send our choice(s) to external private vendors, outside of the Healthcare.gov system.
  3. Integration is not simple and it is not a one-to-one process at the federal level. For every single state that did not create their own marketplace the integration had to be created for that state. What this means, for example in Texas every single district, county, city, zip code combination had to be entered. All of the private insurance companies willing to offer plans for Texas citizens had to offer those plans to the marketplace. The State of Texas vetted those plans and made their own rules that had to be incorporated into the system.
    1. This was true of every single state. Every Red State that did not create their own Marketplace made up their own rules; rules in many cases with the sole intention to case the ACA to fail in their state, to prevent their citizens from accessing Affordable Insurance and ultimately affordable healthcare.
    2. Finally, nothing in Healthcare.gov stores your medical information, thus nothing in Healthcare.gov is in non-compliance with HIPPA. Keep in mind, one of key provisions of the ACA is the elimination of ‘pre-existing conditions’. With this provision, you and I no longer fill out extensive medical histories when applying for Health Insurance, in fact the only information we are asked is if we smoke.

If you are a Democrat, Liberal, Progressive or Left Leaning Independent please stop referring to Healthcare.gov as Obamacare or the ACA, or even a Website. It is none of these. It is just one of several delivery systems for the Patient Protection and Affordable Care Act, it isn’t the entirety of it. Could it have been done better? Yes, certainly, it could have been and I suspect all that is wrong with this particular delivery system will be corrected fairly quickly but let’s not fall into the trap the Right is laying for us, let’s not repeat their idiotic talking points as if they were gospel.

The truth is we are now going to have to watch as the GOP members on the Hill waste valuable time and money following their boogiemen down every conspiracy hole. Their insatiable appetite to find this President at fault for something, anything is horrifying, wasteful and frankly boring. The propagandizing by the Right is tiresome; that we fall into their trap repeatedly is shameful. They throw the Red Herring and we run with it.

I am a bit annoyed. Truthfully, I am more than a bit annoyed, I am over the top, heels over ass pissed the hell right off. What is wrong with people? By people, I do have specific people in mind.

I could list the seventy-nine seditious ass clowns who signed the letter initiated by North Carolina Junior Representative Mark Meadows; instead, I will simply provide you the link to his site, which includes the letter and the signatures1. I want to talk about something other than the shutdown of the United States government, though my subject is closely tied to this one.

I don’t want to talk about those subversive son-of-bitches in D.C., they simply do not care; keeping in mind, they are still collecting their pay. Don’t be fooled by their sad eyed bullshit, they got their checks on September 30 through Direct Deposit and are not expecting another until October 30. They cannot ‘defer’ their own pay; no indeed not, it is all a great big lie. The only thing they can do is donate it and very few of them are doing that.

So let’s talk about what is equally important, what is critical to the function of our government and your and my voice in the future. We don’t have much of one left because the last time something this important was before SCOTUS we blinked. If we blink this time, we lose our voice, perhaps forever.

McCutcheon v. FEC

With Citizen United v.FEC the door was opened to corporations, giving them the same voice citizens had in the workings of our government. Now of course this isn’t true, corporations, especially multi-national corporations, have a great deal more money than you and I thus they had more to give. In essence, what SCOTUS said with their ruling, money is speech, corporations just like you, and I have the same First Amendment Rights to Free Speech. Citizen United broke the dam, opened the floodgates and the money poured in as the legislators at every level (federal, state and local) draped  “For Sale” signs around their necks and stuck their hands out. The voice of the citizen, it was drowned out by the voice of the big business and their CEO’s, as it never had been before.

We were asleep. We let this happen. Only after the fact, have some of us woken up to what this meant to our political systems, to our democratic republic. Now, only after the fact we do we bemoan the loss of our voice in Congress. Now, as we watch the Koch funded Tea Party terrorist shut down the government do we shake our head in dismay and question our reasoning. Now, as we watch those sleazy and ignorant knuckle draggers obstruct the appropriate workings of our government and threaten the economy of this nation and the f’ng world, do we realize what it meant to cede our authority and our voice in the government “by the People and for the People” do we realize what ‘money as speech’ means. Unfortunately, there are still those, even those without a pot to piss in or window to throw it out of, who continues to defend Citizens United, the Tea Party and those who would strip the very meat off their bones.

So, let us quickly talk about McCutcheon v. FEC, which was argued before SCOTUS on 8-October to raise further individual campaign limits to $3.5M per donor to a single party’s candidates, parties or committees. Previously, a single donor was limited to $123,000 in direct donation to parties or committees, or $2,600 in individual contributions to 17 candidates for a total of $46,200 and an additional $70,800 to a political action committee (PAC) or group within a two-year federal cycle. Keep in mind this is only on the federal level, these wealthy donors are not similarly limited at the state or local level. Mr. McCutcheon though, he is outraged his voice is limited, his ability to buy his own personal Congressman or woman is limited in this way.

Those who have joined in his suit, they are also similarly outraged. They are:

  • The Republican National Committee
  • Senate Minority Leader Mitch McConnell, joining as an outside party

Oh, did I forget to mention Shaun McCutcheon is a little known multi-millionaire from Alabama who is active in conservative circles? Yes, indeed our friend Mr. McCutcheon is another one of the ‘big’ donors who likes to buy up legislators to make certain his personal agenda is well represented at the expense of all the rest of America’s citizens. He is the CEO of Coalmont Electrical Development, an engineering firm specializing in mining. He is according to the chairman of the Alabama Republican Party, Bill Armistead, a sincere Republican and Activist. This sincere member of the 1% first broached the idea of his lawsuit to further strip your and my voices from the public forum at the 2012 Conservative Political Action Conference (CPAC)2.

We need too really think hard about this one for just one minute, currently a single donor can give $123,000 in any two-year cycle. This amount is twice what the average American family earns, that is two times what the Average American Family has to pay their bills with, save against catastrophe with, save for their children’s future education with, pay for their healthcare with, feed themselves with and contribute to political campaigns, candidates, committees and parties from. A bit of history is important, limits were put in place to prevent corruption or the appearance of corruption after Nixon and the Watergate scandal of the 1970’s. Watergate led to changes in campaign financing, as well as, the Freedom of Information Act in 1974. In addition to these legislative changes, it became expected that candidates would disclose personal finances including tax filings. In fact, Mitt Romney was the first presidential candidate since that time to balk at the release of personal financial information, wonder why that was.

So we must ask the question, like so much else we achieved to move this nation forward toward equality in the past one hundred years, why this why now? I think I can answer this question, we have the perfect storm, we have a court that will continue to strip away, every progressive accomplishment and every citizen’s right we have gained. Someday, those at the top will look back and it won’t be Ronald Reagan they will worship it will be George W. Bush, who tipped the scales of the Supreme Court in their favor.

Are you willing to see this happen? I am certainly not prepared for the slide backward, not in my lifetime. I am constantly astounded when anyone who is barely able to meet their rent or mortgage defends the likes of Shaun McCutcheon, the infamous Koch brothers or for that matter the GOP and their slimy Right Wing minority the Tea Party contingent. Is it not clear yet? These people are not your friends, their version of the American Dream is an American Nightmare for 99% of us, this Shutdown is only a taste of what is to come under their vision of our future.

Tell SCOTUS, tell your Representative, tell the Administration: Enough is Enough. Return America to the People. Restore Campaign Finance.

Wendy Davis Kicked It

KickmIt has been a very long time since I have been to a political event. This is not because I am disinterested in politics, as anyone who reads me knows. The truth is since my shooting I have an abiding fear of crowds. It is difficult for me to quell my fear, to stop my heart beating outside of my chest. Nevertheless, I did it. In fact, I did it twice in one day and I am glad I did.

On 3-October-2013, Texas Senator Wendy Davis announced she was entering the race for Governor. I was there! The invocation by Tarrant County Commissioner Roy Brooks was old school church, moving and at times funny. In my mind, his most appropriate request:

“We ask you, Lord, to change her pink running shoes into combat boots … so she can do battle against the negative forces that rule this state”.

Following the invocation, former TXU executive Alex Jimenez introduced Senator Davis with his own story of climbing from pole setter to Vice President at the largest power company in Texas. His story was met with cheers from the crowd even if his former employers name was met with jeers. Mr. Jimenez provided a fabulous backdrop to what is possible in Texas, just as Ms. Davis does. Their friendship extends back to her days on the Fort Worth City Council where she chaired the Council on Economic development.

Ms. Davis bounded onto the stage as “This Girl is on Fire” by Alicia Keyes played, the crowd was on their feet and enthusiasm was obvious. I must tell you, my nerves were on edge even as I was happy to be there, excited to be part of Texas politics and thrilled to see a woman of integrity with values close to my own fearlessly stand up knowing just how hard this next year was going to be. Make no mistake; this year is going to be hard for Wendy Davis. Even before she announced her intention to run, the attack dogs were out. Before the black drapes were pulled off her campaign signs, the ugly was being prepared and the negative ads were hitting the airwaves in Texas. From outside Texas things were just as nasty, those tweets rolled off, here are just a few examples:

Of course, lest we forget we have our own champions of ignorance right here in Texas and one of them is currently the front-runner in the gubernatorial race. Greg Abbott is a hypocrite, a far right conservative, a friend and supporter of Ted Cruz; the Tea Party was damned near made for his brand of politics. This man got rich because of a freak accident, not just a little rich mind you but $10M or more rich. He is now a fervent advocate of Tort Reform and derides those who represent individuals in personal injury lawsuits. We can only hope Greg Abbott continues down this path to become the Clayton Williams of this campaign, making it ever so much easier to show the stark contrast of the GOP Neanderthal thinking. Honestly? It doesn’t appear we have made much progress since ole’ Clayton made his ridiculous statements about Ann Richards and rape during their hard fought 1990 campaign. He out spent her 2:1 and was at the time considered a shoe in for the Austin Governor’s Mansion, until this:

Sounds familiar, doesn’t it? Currently Greg Abbott has approximately $25M in his war chest, much of it from out of state. There are no viable sources to tell us where his current war chest comes from yet. However if the history holds true we can expect when Follow the Money, Open Secrets and other reporting agencies start reporting numbers we will see a similar trend to Mr. Cruz and Mr. Perry, millionaires, Big Business, Banking, Big Oil and the far Right-Wing Paks contributing big dollars to keep Texas Red. The single issue nutcases were already out when I pulled up on Thursday, signs a-waving with “Keep Texas Red” and “Pro-Life Texas”, all I could think was dumbasses. I was hoping for a picture of them but by the time I had parked and walked back the police had moved them off.

It was a good day in Haltom City and later in Fort Worth at the reception. People were energized, applauding during all the speeches. The crowd was mixed, all ages from the very young to the octogenarian, every ethnicity and race was represented on the floor and in the surrounding seats. People were smiling, talking to strangers and kind, even for me with my nerves somewhat frayed by the crowd, it was a good day.

Ms. Davis gave a good speech, she talked about her own humble beginnings and why she cares. She focused on how great Texas could be if we got out from under the yoke of Republican rule and the decimation of our education system and the deep cuts to our healthcare, no not women’s healthcare but our overall Texas Healthcare. She focused on the needs of the state, the needs of all citizens to achieve our goals through opportunity. She spoke for just under 15 minutes and she had the crowd on their feet. Most people don’t know Ms. Davis staged her first filibuster on the $5B cuts proposed by Rick Perry and his cohorts in the Republican Party to our education system. Her most recent filibuster for which she is better known wasn’t her first trip to the rodeo.

Senator Davis ended her announcement with this:

“Until every child from Longview to Lubbock to McAllen to Mesquite makes it to a stage like this, and gets their diploma, and knows that nothing will wash out the road to their future dreams, we will keep going,” she said. “Until the corridors of power are the corridors of the people, until problem-solving trumps partisanship, until our state is ‘a lot less lone and a lot more star,’ we will keep going. As long as we can make this great state even greater, we will keep going. Because with the right kind of leadership, the great state of Texas will keep its sacred promise that where you start has nothing to do with how far you can go.”

Omnipotent Really

Hands_of_God_and_AdamWhat if you had a single day to do whatever wanted, just one single day. Whatever you did would remain, no one could undo it or wish it away. What if you or I were granted the power to affect change, what would you do with that single day and all that power.

The ramifications of that much power at the tips of your fingers sounds spectacular, doesn’t it?


Untutored in being an omnipotent  entity would we look around and begin to right all the wrongs we see? Where would we start?

But wait, your vision of utopia might not be the same as mine? Your changes might well bring misery to others. You are a minority of one, you could of course choose to talk your decisions over with others or simply go it alone.

What will you do? How to choose with this great power to make dreams come true and only a single day to accomplish it all in. This could well give you a few grey hairs by the end of the day.

Maybe you would cure terrible disease, eradicate Aids and Cancer, other scourges Alzheimer’s and Dementia. That leaves so many other terrible plagues though, maybe you could broaden your scope and eliminate all illness from the world now and in the future.

Bring peace to all the lands, causing all the warriors to put down their weapons of death. Eliminate all the horrible tools of mass destruction, the poison gases and nuclear bombs. But in doing this could you also eliminate all the reasons for war?

Conceivably it is something of more immediate concern you would try to change, something more in your neighborhood, something more real to you. What would that be? Are you in the United States? Would you consider the violence marring our landscape and think, ‘I can fix this with a wave of my hand’. Then do it. How would that look afterward, would the Constitution suddenly be without the 2nd Amendment or instead would our attitudes, our culture of violence the hearts and minds of our citizens be changed. Could you possible conceive of what this means? What is underneath this terrible culture of death and mayhem, this murderous nature of ours. How did you fix the trajectory? What are the ramifications of your ‘fix’?

There are so many things any one of us might pick on our day of omnipotence, while we sit in our seat of power with just twenty-four hours to exercise our will. We could of course choose the selfish way out of this dilemma, we could choose to do not one damned thing at all for World Peace, Earth or Human Unity. We could choose instead to do only selfish things, things that serve only ourselves. We could promise with our new future we will do good works later when we have fixed ourselves first.

Do you think I am rambling just for the sake of it? No, I am really not.

There is this idiotic rumbling by many in our nation the President isn’t doing enough, I have to ask, enough what? He is one man and he is not infused with omnipotence through his election. In fact, the President of the United States does not write the law, he does not vote on the laws that are written, he has the limited power of doing one of two things when they arrive at his desk from Congress; he can sign them into law or he can veto them.

The President is not a God, not even a minor God. He does not have the power to wave his hand and fix what is broken. Unfortunate really given the situation this nation finds itself in this morning. The tawdry demagogues of the far Right have brought our government to a screeching halt, as they had planned since before they took power in one house of Congress in 2010. Their self-awareness is limited to what they want, what they have promised to their constituents since before the elections of 2010, Anarchy. It doesn’t matter what the issue is, only they bring down the government:

  • Budget Cuts – give us our way or we will shut it downAnarchy Reigns
  • Planned Parenthood funding – give us our way or we will shut it down
  • Block access to birth control for women – give us our way or we will shut it down
  • Repeal ACA (twice) – give us our way or we will shut it down

The above are only the five (5) times and a partial list of why, the House Republicans have pushed this government to the brink of shut down. Until now, today government workers in all branches of government have been ordered to proceed with shutdown activities, take their toys and go home until further notice. TURN OFF THE LIGHTS.

I did not include in the above the two (2) times those same selfish Azzhats from the Tea Party and their beaten allies from the original GOP threatened to carry this nation over the Fiscal Cliff, not pay our bills, not raise the debt ceiling. Of course, what these irresponsible idiots fail to understand or maybe simply do not give two shits about, the first time they did this our Bond Rating was lowered making the cost of credit higher. By threatening the Full Faith and Credit of the United States, they threaten not just the economy of this nation but the economy of the world.

Since the GOP took power in the House, they have not passed a single piece of relevant new legislation; in the two years prior to their taking over the House fifteen (15) major pieces of new Legislation were passed. They have obfuscated and obstructed, they have threatened and they have puffed up their chests along with fear mongering among their base. Their hubris is monumental in the face of their failure to accomplish a single positive outcome for this nation.

So, Anarchy rules in the House. The Government of the United States is Shut Down. Eight hundred thousand government workers will be without paychecks and we do not know for how long. Government services will not be open for business, the only good news on this one NO NEW GUN PERMITS.

Guess what? ACA is open for business, Americans can start signing up today.

So if you were omnipotent for just one day what would you do?

They called it Camelot, the brilliant 1,022 days of the Kennedy Presidency. The young president with his beautiful wife and young children entered the White House full of the hope and dreams of a nation, the baton was passed from old guard to new. It was a new dawn where politicians, actors and artists mingled over meals and danced together into the dawn. The nation was mesmerized, as they watched on their televisions this young and handsome president, his brothers and friends take Washington by storm.

Inarguration Day

JFK was the youngest president ever elected; he was also the first Roman Catholic. His campaign was the first ever televised his speeches the first seen by more than those in the room with him, the four presidential debates the first both seen and heard. Though his Catholicism was considered a deterrent by many he was able to deflect questions about his religion when asked, ultimately this became a non-issue with many voters though not with all especially among Southern Protestants. The one thing to keep in mind when considering the Kennedy Presidency, he barely beat Nixon, it was a neck-and-neck race right down to the end with the electoral vote finally deciding the presidency and even this being questionable due to the unpledged Southern Segregationist Electors who refused to cast their vote for the Kennedy ticket. Ultimately, this is what both the popular and Electoral College vote looked like:

So now, we come to it 1,022 days of Camelot. What did he accomplish and during this time what nefarious acts, scandals and outrages was the Office of the President or those around him involved in? Surely, given the advent of television and the hunger of the American public for gossip we know what went on in the inner circle of this damned near American Royal family inhabiting the White House.

Of political scandals, poorly managed foreign affairs there have been much written over the years. The question becomes, why was so much so closely held for so many years? What drove this Administration to muck up relationships with USSR Premier Khrushchev was it simply generational and language barriers? Or, as some who witnessed the Summit of 1961, both public and private the egos of both men that played large parts in their inability to find any common ground. It is likely we will never know however certainly we can consider the cocktail of drugs the young president relied upon for pain management as one possible reason for his inability to process information, think quickly on his feet and act pragmatically rather than emotionally.

There are key political issues that haunt the Kennedy tenure in the White House; these were all driven by the Cold War and the legacy of the Eisenhower administration. All were failures in their execution though not all were considered failures at the time or even today, all have been white washed by press and biographers alike.

  • Invasion of Cuba, aka Bay of Pigs: 17-April, a CIA led excursion was originally planned by the Eisenhower administration, ultimately cost $53M in food and medicine in exchange for captured 1,189 survivors of the Spring Mobilizationfailed invasion and attempted overthrow of Fidel Castro. Many consider this a failure of Eisenhower plan rather than of JFK.
  • Cuban Missile Crisis: this really was more than a US issue, based on spy plane pictures of Soviet ballistic missile sites built in Cuba the National Security Council and the President reacted by beating the drums of war. The world reacted differently, with the UN Secretary General stepping in to request a cooling off period after the announcement by the President of a naval blockade. Ultimately, the world prevailed and good sense won. The missiles in Cuba were removed, the offending US missiles in Turkey were removed and the US promised to never invade Cuba again. Many believe this represented a success for the administration and the president saw is ratings rise to 77%.
  • The CIA was the first line of defense against communism throughout the world. One focus was South America and stopping the spread of the dread political enemy of freedom in nations so close to our own. One tool was assassination, Fidel Castro of Cuba and Rafael Trujillo of the Dominican Republic. In the case of Castro, we know they failed. In the case of Trujillo, there has always been a debate whether they were involved or not in his assassination and to what extent.
  • NATIONAL SECURITY ACTION MEMORANDUM NO. 124, 18-January-1962: Authorized the escalation of troops in the first war that couldn’t be won, Vietnam.2

The beleaguered JFK was not originally intended for political office, upon the untimely death of his brother Joe Jr. he was queued up to fulfill the family ambitions. Jack was plagued by health problems from an early age; over time, these would be exacerbated by his reliance on cocktails of drugs including painkillers and amphetamines. He was also what today we would call a sex addict, though frankly this is simply an easy out for someone lacking self-control. His womanizing was well known within his inner circle and included both the famous and infamous; many of those who were tasked with protecting him extended their protection to include his reputation, even the press corps of the day kept his secrets.

The ambiguities of JFK the man versus JFK the public figure, father and husband were kept or was it simply that as a nation we were not interested in the personal lives of those in power? That the President cheated regularly on his young wife with stars the likes of Marilyn Monroe did not cause us to raise our moral hackles in outrage so long as he continued to do the work of President. One can only wonder why this President with known ties to Sam Giancana the Chicago Godfather, Frank Sinatra leader of the Hollywood Rat Pack and his many lovers was not in the eye of the storm for his many indiscretions.

Did this young president during the course of his 1,022 days in office do good? He set the stage to do good in some arenas certainly. He set the foundation for Civil Rights to move forward. He established the Peace Corps, which continues to this day. He signed the first Nuclear Test Ban treaty. Many of the Kennedy proposals for domestic policy including those for the New Frontier would not be carried out prior to his assassination in Dallas, Texas on 22-November-1963 but would ultimately be signed by his successor Lyndon B. Johnson.

How would we, as a nation have viewed this young and morally challenged President had he lived? Would his indiscretions come to light? Would the nation have cared? Would Vietnam continue to escalate; there are some who believe he would have pulled our troops out but for re-election concerns; “We don’t have a prayer of staying in Vietnam. Those people hate us. They are going to throw our asses out of there at any point. But I can’t give up that territory to the communists and get the American people to re-elect me”.3

I know many deify JFK, frankly seen through the prism of history; he is not my favorite president. My personal opinion is he was without a moral compass, he was arrogant and self-centered, drugs impaired his cognitive abilities and he had a tendency to be ruled by his emotions, including his feeling of not being ‘good enough’ based on his relationship with his overbearing father. JFK frequently did what was right, not because he believed in it, not because it was the right thing to do but instead because of the political consequence, he had to have his hand forced.

I thought I would be able to write both the Kennedy and Johnson tenures into a single post, I was wrong. Thus, I bring to an end part two of the High Crimes and Misdemeanors series.

High Crimes and Misdemeanors, Part I

The current POTUS (President of the United States) is chased by scandal, whether ridiculous conspiracies ginned up by those too simple-minded too accept the nation has moved beyond their narrow views or alternatively they might indeed have some meat. The truth of the matter since the election of Barack H. Obama, our government seems incapable of doing the work of the people, the work we pay them to do, the work we send them to Washington to do. Instead, we are fed a constant barrage of trash talk, conspiracy theories and Committee Investigations, most leading nowhere; most frankly an insult to the intelligence of any person of normal intellect.

With this in mind, let’s investigate the Administrations since Dwight D. Eisenhower, who in my opinion (humble or otherwise) was the last great Republican President. So lets us together pull the curtain back, we seem to have very short memories.

The years of President Eisenhower’s administration were comparatively scandal free, sure his Vice President embarrassed him a time or two, most specifically when VP candidate Richard Nixon had to explain away his acceptance of personal gifts, the Checkers Speech is classic in response to this charge.

Also during his Administration his Chief of Staff, Sherman Adams was forced to resign under a cloud, including Contempt of Congress, they were investing whether his wife received personal gifts. There were a few scattered personal scandals within the legislative branch, nothing that could be tied back to the President. Interestingly, there was never an investigation whether the President was receiving nookie on the side during his service as Supreme Commander of Allied Forces, though his relationship to Kay Summersby was well known and questionable. I suppose people, including press and his political adversaries simply thought this was none of their business, funny how that worked in the far more conventional 1950’s.

What happened during the Eisenhower presidency of note?

  • He signed the Federal Aid Highway Act of 1956, which gave us the Interstate Highways and national investment in our infrastructure.
  • He signed the very first Civil Rights Act of 1957, creating the very first office within the Department of Justice to investigate Voters Rights; Congress amended and weakened its effectiveness significantly.
    • Despite President Eisenhower’s commitment to Civil Rights on paper, his failure to immediately, actively and publicly support the Brown decision slowed down integration of schools. Had he acted sooner and more publicly there would have been far greater support for the later Civil Rights Act he also signed and it is likely integration would have been achieved with less violence.
  • He balanced the budget, not one time but three times, through moderate, even progressive fiscal policies including his refusal to raise defense spending and cut taxes. This despite pressure from his own party.

The presidency of Dwight D. Eisenhower, the last of the moderate and reasonable Republicans wasn’t without its detractors. In fact, because President Eisenhower was a moderate, even progressive Republican many of the Old Guard were tactically against his policies. President Eisenhower continued many of the policies of the New Deal, even strengthening Social Security and creating a new cabinet level agency, The Department of Health, Education and Welfare. He finished what the previous administration of Truman had started, the integration of the Armed Forces, over the objection of those in command. He declared segregation of the military a National Security Risk.Dwight_4

What did President Eisenhower consider his personal failures? Good question, one I suspect he would be hard pressed to answer today in retrospect of fifty-two years, however based upon easily found quotes of the time, here are my suppositions or assumptions:

  • President Eisenhower saw his party moving more and more to the Right, growing more conservative and less mainstream. One of his personal goals was to re-energize his party, make it more mainstream and acceptable to the average citizen. Many of his speeches indicate his desire to reach out to all citizens, engage all members of society. He was deeply disappointed by the nomination of Barry Goldwater as the Republican candidate in 1964.
    • Hmmm, sounds like even then he recognized the big tent was getting smaller and less welcoming. Wonder what he would think now, don’t you?
  • McCarthyism was officially ended in 1954. However, the Red Scare Purge continued for several years after the Senate ended Senator Joe McCarthy’s career. President Eisenhower failed to put a stop to it and thus many innocent lives were destroyed.
  • Expansion of the Industrial Defense Complex, he warned of this more than once and in many speeches. He derided those who built upon fear of the populace to gain power for powers sake. His most powerful warning came in his farewell address on January 17, 1961.
    • Despite, or perhaps because of his successful career as a General in the US Army he despised war, he ended the Korean War and for the most part kept us out of others.
    • His one great failure? He put the first troops in Vietnam!
  • I don’t think President Eisenhower would consider this a failure, I however do. During his Administration, Congress and he gave into a high-pressure campaign by the Knights of Columbus, a Catholic Fraternal Order, to change the currency and the Pledge of Allegiance of the nation. The change to our currency removed our motto, “E Pluribus Unum” or in English, “One from Many”. While the history of the change of the motto on coinage in fact goes as far back as 1886, it was struck down during the Roosevelt Administration and not reinstated until Eisenhower’s Congress and Administration gave into the campaign of the Knights of Columbus.
    • Now our Pledge is both a patriotic pledge and a public prayer.
    • Now our currency is a statement to the rest of the world we are a theocracy rather than a Democratic Republic.
    • Talk about short memories, how many people do you know (including elected officials) who are quick to say, “We are a Christian Nation” and believe it.

It is unfortunate, despite some of his personal failures the Republican party of today do not look back on this humble man, this war hero and truly great American and hold him in better regard. As we will see, his tenancy in the White House was the last of the scandal free Administrations, of either party. Though certainly many of the scandals of the Left tend to be more manufactured and those on the Right tend toward high-crimes. But don’t let me sway you stick around for the next in the series, John F. Kennedy and Lyndon B. Johnson years.

After thousands of flight delays across the country this week, the United States Senate voted Thursday night to give the Federal Aviation Administration the flexibility to keep the nation’s airports running smoothly. The delays were caused by the furlough of air traffic controllers, who were rotating off the job because of sequestration’s automatic budget cuts that began taking effect on March 1. The Senate legislation, which passed the House today and will be signed by President Obama, will allow the FAA to shift the burden of its cuts around, removing the need for controller furloughs and the delays that come with them.

That means lawmakers will be able to fly home for recess this weekend without any delays — and tourists and people who travel for business won’t have to experience the delays either. Unfortunately, though, Congress…

DOMA Dammit

soapboxpileDOMA, The Defense of Marriage Act, signed by President William Jefferson Clinton on 21-September-1996 to protect ‘marriage’ and the government. No, Bill Clinton does not get a pass on this despite his current stand in support of Gay Marriage, despite his ‘Don’t do as I did, do as I say now.’ DOMA was then and is now an over-reach by the Federal Government based on Christian standards of marriage being between a one man and one woman, this despite there being nothing anywhere in the Bible to support this view, in fact if we want to be specific the Mormons had it right didn’t they? There are plenty of examples sprinkled throughout that tome our friends in Washington and all their little legislator whisperer’s like to point to when in doubt of marriage being between One Man and plenty of women.

Now that is today, in 2013 the social tide has shifted tremendously and the majority of the public isn’t so certain it is fair or even right to withhold Civil Rights from their fellow citizens simply because they are different. Different as in, they want to marry the same gender versus the opposite gender, nothing more or less that is really the only difference. They are now and always have been part of our society, they do now and always have paid taxes, fought in our wars, lived next door to us, had families, formed long-lasting and monogamous relationships. What they haven’t had, what we have prevented them from accessing is all the rights and privileges we take for granted, things like;

  • Rights of survivorship
  • Inheritance
  • Immigration
  • Next of kin, medical decision making and the right to visit a loved one in the hospital
  • Parenting children born in the relationship after the death of the natural parent
  • Tax benefits
  • Healthcare benefits
  • Social Security survivorship benefits
    • And a host of both private and public benefits marriage allows

All this because there are some people within our society, predominantly within the Christian

Evangelical Right who gained a heavy foothold in our government

and demanded their rights supersede the rights of others.  These

Christians demanded their religious standards and beliefs be written

into the law and be enforceable based on their interpretation of the

Bible. This despite the First Amendment of the Constitution, guaranteeing our individual right to be free to worship and free of a state sponsored religion.

Thus far, eight (8) Federal Courts have found section 3 of DOMA unconstitutional, this includes both the First and Second Courts of Appeals. Today was the second day of oral arguments before the Supreme Court in United States vs. Windsor. It is important to note, the Administration and the Justice Department refused to defend DOMA, John Boehner, Speaker of the House used House Rules to convene the Bipartisan Legal Advisory Group and subsequently hire a private law firm to defend DOMA before SCOTUS. I suppose the GOP just can’t let go.

Nevertheless, on to my real issue, where do these idiots come from? What rocks do these azzhats crawl out from under? Really, this one is presumably educated, talented, knowledgeable and highly respected in his field. This narcissist gives me a true case of the red ass I must say. He became the darling of the right wing simply by showing he had no class, by taking the President to task in a public forum; big f’ng deal you are classless. But then, so are most of those you are attempting to emulate you fit right in.

Let me just ask how did you get through medical school and not ‘believe’ in evolution? How do you teach at Johns Hopkins and not know the most recent findings on homosexuality?

How is it possible for presumably educated people to be so steeped in personal prejudice, personal bias they fail entirely to step out of their own box. I think SCOTUS is going to find in favor of Ms. Windsor, I think they will find section 3 unconstitutional and strike down DOMA. This will mean we still have a very long ways to go, each state will still be putting the rights of our fellow citizens to a vote but it is at least one step in the right direction.
